RESOLUTION NO. 559
A RESOLUTION OF THE CITY OF BAYTOWN, TEXAS , OFFICIALLY
OPPOSING SENATE BILL 106.
WHEREAS , the Texas Legislature enacted the Harris-
Galveston Coastal Subsidence District Act in 1975 to regulate
withdrawal of underground water for the purpose of ending
subsidence that contributes to and precipitates flooding,
inundation, and overflow of property by water from storms,
and hurricanes; and
WHEREAS , subsidence caused by ground water withdrawal
continues to be a costly, extensive, and life endangering
problem for people within and without the boundaries of the
subsidence district ; and
WHEREAS , ground water withdrawal from the Lagarto ,
Goliad, Willis , Lissie , and Alta Loma sand formations within
the aquifers beneath the surface lands of Harris and Galveston
counties will contribute to subsidence and its related
problems regardless of the location of the wells or the use
to which the withdrawn water is put ; and
WHEREAS , although the City of Baytown recognizes that
some economic hardship is imposed upon persons who seek
permits to withdraw water under the Act , the City is in
particular position to attest to a far greater economic
hardship and potential devastation posed by continued unreg-
ulated ground water withdrawal and subsidence; and
WHEREAS, Senate Bill 106 has been introduced to amend
the Harris-Galveston Coastal Subsidence District Act by
adding exclusions for all residential dwellings and wells
used for agricultural purposes; and

WHEREAS , these added exclusions would seriously jeop-
ardize the effectiveness of the Harris-Galveston Coastal
Subsidence Act ;
NOW THEREFORE , BE IT RESOLVED:
THAT the City Council of the City of Baytown officially
opposes Senate Bill 106, amending Section 43 , Chapter 284 ,
Acts of 64th Legislature, Regular Session , 1975, relating to
exclusions from the provisions of the Harris-Galveston
Coastal Subsidence District .
INTRODUCED, READ, and PASSED by the affirmative vote of
