CC Resolution No. 527 762 RESOLUTION NO. 527 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS , AUTHORIZING AND ENTERING INTO AN INTERLOCAL AGREEMENT BETWEEN THE CITY OF BAYTOWN, TEXAS , AND HARRIS COUNTY FOR COMMUNITY DEVELOPMENT FUNDS . WHEREAS , the 93rd Session of the Congress passed and the President of the United States signed into law, the Housing and Community Development Act of 1974 for the specific purpose of developing viable communities , and WHEREAS , Harris County has been designated as an "URBAN COUNTY" by the Department of Housing and Urban Development entitled to a formula share of program funds , THAT, Article III , Section 64 of the Texas Constitution authorizes Texas counties to enter into cooperation agree- ments with local governments for essential community development and housing assistance activities , NOW THEREFORE be it resolved, by the City of Baytown , Texas , that the Mayor and the City Council support the application of Harris County for funding of the Housing and Community Development Act of 1974. To this end : (1) The City of Baytown asks that its population base be included with that of Harris County for all of fiscal year 1976. (2) The City of Baytown joins with Harris County in the development of a Community Development Program pursuant to Title I of the Housing and Community Development Act of 1974 for the mutual benefit of both the City and the County. The City agrees to allow the Department of Housing and Urban Development to use its population 763 base and other necessary demographic characteristics in the determination of the County' s population base , and that the City will be entitled to its proportionate share of said funds. (3) Authorizes Harris County to administer within the City of Baytown such projects as designated by the City of Baytown when undertaking essential community development • and housing assistance activities , specifically urban renewal and publicly assisted housing, if these activities are specified in the application , and all other activities listed as "Community Development Program Activities Eligible for Assistance" under Public Law 93-383 The Housing and Community Development Act of 1974 , Title I , Section 105 , and listed as "Eligible Activities" under the Code of Federal Regulations, Title 24 , Chapter V, Part 570 as amended, "Community Development Block Grants. " (3) (a) The City of Baytown , recognizing that Harris County will incur certain administrative and legal expenses on the City' s behalf , agrees to reim- burse Harris County in the sum of fifteen (15) per cent of the proportionate share of funds allocated to the City of Baytown; said reimbursement to be paid at the time all applications and grants are approved and awarded for the benefit of the City. (4) All agreements by and between the City of Baytown and Harris County shall be governed by and subject to the Housing and Community Development Act of 1974 and those rules and regulations promulgated by the Secretary of the Department of Housing and Urban Development . -2- 764 (5) All accepted applications for grants pursuant to this or any other agreements governed by and/or subject to the Housing and Community Development Act of 1974 shall remain in full force and effect for the entire funding period of the accepted application. The application in no event shall be terminated prior to the expiration of the entire application funding period. (6) The City Council of the City of Baytown , Texas , by resolution (which is attached hereto and incorporated herein for all intended purposes) authorizes the Mayor of the City of Baytown, Texas , to sign this Cooperation Agreement and such additional forms as requested by the Department of Housing and Urban Development pursuant to the purposes of this resolution. HALL, City Clerk Date WHEREAS , the Commissioners ' Court of Harris County desires to improve the living environment within its entire jurisdiction, and WHEREAS , Commissioners ' Court of Harris County is the governing body of Harris County and does hereby agree to all terms and conditions as outlined in the above resolution , -3- 765 THAT, they hereby enter into a cooperation agreement with the City of Baytown , Texas. NOW THEREFORE , be it resolved that Judge Jon Lindsay as Chief Executive Officer of Harris County is hereby authorized to sign this Cooperation Agreement and all additional forms as required by the Department of Housing and Urban Development pursuant to the purposes of this resolution .
