CC Resolution No. 524 757 RESOLUTION NO. 524 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS , OFFICIALLY CONCURRING WITH ' AND ENDORSING THE STUDY REPORT OF THE DEPART- MENT OF THE ARMY, CORPS OF ENGINEERS . WHEREAS , the District Engineer , U. S. Army Engineer District , Galveston , Texas , has prepared a study report to investigate flooding problems in areas of Baytown, Texas , adjoining Burnett , Crystal , and Scott Bays, with particular reference to past and future effects of general land subsidence on the severity of flooding, and to determine the feasibility of a plan for mitigating the flooding problem; and WHEREAS , such study report has been reviewed by the Division Engineer , U. S. Army Engineer Division , Southwestern , Dallas , Texas ; and WHEREAS , such study report has been submitted to the Board of Engineers for Rivers and Harbors for review and interested parties may present written views on the report ; and WHEREAS, said report concludes that "mitigation of the land subsidence problem will depend on a systematic program of conver- sion from ground water supplies to surface water supplies, that the problem is regional in scope and not confined to the area of this study , and that the impetus for such a program must originate with state or local governmental entities" ; and WHEREAS, even though not mentioned in the study report , national demand for energy and for goods produced by industry in the region where subsidence is occurring has contributed to the problem and therefore causes it to be one of national interest and concern; and WHEREAS , the City Council of the City of Baytown is in agree- ment with such study report and wishes to officially convey to the Board of Engineers for Rivers and Harbors its concurrence with said report and at the same time, point out that House Bill No. 552 , �r 758 entitled Harris-Galveston Coastal Subsidence District , State Legislation aimed at bringing about a systematic conversion from ground water supplies to surface water supplies has already been adopted by the 64th Legislature of the State of Texas in 1975 and is now being implemented; and WHEREAS , regarding House Bill No. 552 , the City Council of the City of Baytown wishes to call the Board' s attention to the fact that such legislation was introduced and ultimately passed as a result of a united effort on the part of many local govern- mental entities in the Texas Gulf Coast Region ; and WHEREAS , the City Council of the City of Baytown further wishes to point out to the Board that in 1973 , as a direct result of the efforts of City of Baytown officials and the State Repre- sentative who represents the Baytown area, House Bill No. 967 entitled, Baytown Area Water Authority , was introduced and passed, thereby creating an Authority which would permit an economical conversion by the City of Baytown and surrounding areas from ground water supplies to surface water supplies, and further , that said Baytown Area Water Authority is presently actively negotiating with suppliers of water for the purchase of a future water supply for the entire Baytown area; and WHEREAS , the City Council of the City of Baytown wishes to urge the Board to consider that , with the advent of the afore- mentioned State Legislation , and because of the awareness of local government officials of the causes and the impact of subsidence , subsidence is being curtailed so that the effects thereof will not worsen or effect other areas in the future; NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: Section 1 : THAT the City Council of the City of Baytown officially concurs with and endorses the study report prepared -2 759 by the District Engineer , U. S. Army Engineer District , > Gaveston , Texas, and calls the attention of the Board of Engineers for Rivers and Harbors to the fact that specific State Legislation has been adopted by the Legislature of the State of Texas designed to eliminate the causes of subsidence so that the effects of subsidence will not worsen or spread to other areas and ultimately subsidence will be halted.
