CC Resolution No. 495 RESOLUTION NO. 495 A RESOLUTION ADOPTING THE PROVISIONS OF HOUSE BILL NO. 607, ACTS OF THE 63RD LEGISLATURE REGULAR SESSION, ALSO KNOWN AS ARTICLE 999b, SECTION 2a OF THE REVISED CIVIL STATUTES OF TEXAS; PRO- VIDING AN AGREEMENT TO FORM A MUTUAL AID LAW ENFORCEMENT TASK FORCE KNOWN AS THE HARRIS COUNTY ORGANIZED CRIME CONTROL UNIT FOR THE PURPOSE OF COOPERATING IN THE DETECTION, CONTROL AND PREVENTION OF ORGANIZED CRIME; LISTING THE MUNICIPALITIES AND COUNTY PRIVY TO SUCH AGREEMENT; PROVIDING THAT PEACE OFFICERS ASSIGNED TO SUCH UNIT BE COMPENSATED BY THEIR RESPECTIVE MUNI- CIPALITIES OR COUNTY; PROVIDING THAT PEACE OFFICERS ASSIGNED TO SUCH UNIT WITHIN THE SCOPE OF THE STATED PURPOSE SHALL HAVE THE SAME AUTHORITY WITHIN THE CITY OF BAYTOWN AS ANY PEACE OFFICER REGULARLY EMPLOYED BY THE CITY OF BAYTOWN; PROVIDING A SAVINGS CLAUSE; AND PROVIDING AN EFFECTIVE DATE. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1 : That the provisions of House Bill No. 607, Acts of the 63rd Legislature, Regular Session, also known as Article 999b, Section 2a, of the Revised Civil Statutes of Texas , be, and the same are hereby adopted by the City of Baytown, Texas. Section 2: That the City Council of the City of Baytown by this re- solution , enters into an agreement to form a mutual aid law enforcement task force known as the Harris County Organized Crime Control Unit for the purpose of cooperating in the detection, control and prevention of organized crime. Section 3: That the following municipalities and county are privy to such agreement: County of Harris City of West University City of Houston City of Bellaire City of Baytown City of Hunter's Creek Village City of Pasadena City of Hedwig Village City of Deer Park City of Bunker Hill City of South Houston City of Piney Point Village City of Galena Park Section 4: That the peace officers assigned to such Unit shall be com- pensated, including pension , disability, injury and death benefits , by their respective municipalities or county. Section 5: That the peace officers assigned to such Unit and acting within the scope of the stated purpose shall have the same authority within the City of Baytown as any peace officer regularly employed by the City of Baytown. Section 6: Savings Clause: If any provision , section, subsection, par- agraph , sentence, clause or phrase of this resolution or the application of same to any person or set of circumstances , shall for any reason be held unconstitutional , void or invalid, such invalidity shall not affect the validity of the remaining provisions of this resolution or their applicaton to other persons or sets of circumstances and to this end all provisions of this resolution are declared to be severable. Section 7: Effective Date: This resolution shall take effect from and after its passage by the City Council of the City of Baytown , Texas.
