A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS,
AMENDING RESOLUTION NO. 1 WITH REGARD TO PARLIAMENTARY RULES OF
PROCEDURE.
WHEREAS, Section 27 of the Charter of the City of Baytown provides that the
Council shall determine its own rules and order of business ; and
WHEREAS, by the adoption of Resolution No. 1 on the 25th day of October, 1962,
the City Council of the City of Baytown formerly adopted Robert's Rules of Order
as the rules of procedure to govern the proceedings of the City Council ; and
WHEREAS, it has come to the attention of the City Council that pursuant to
Robert's Rules of Order, the presiding officer is precluded from participating in
discussion on pending questions ; and
WHEREAS, the City Council is of the opinion that the Mayor of the City of
Baytown being an elected official owes a duty to the electors to voice his opinion
on questions pending before Council , as well as to vote his conviction on said
issues ; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS:
Section 1 : THAT Section 10 of Resolution No. 1 of the City Council of the
City of Baytown as presently constituted is hereby repealed, and the same shall
cease to have force and effect from and after the effective date of this resolution.
Section 2: THAT Resolution No. 1 of the City Council of the City of Baytown
is hereby amended by adding thereto a new Section 10 which shall read as follows,
to wit:
Section 10. Robert's Rules of Order: The rules of procedure as stated in
Robert's Rules of Order (Revised) shall govern the proceedings of the City Council
except when in conflict with the provisions of the City Charter or City Ordinances
or the Rules of Procedure hereby adopted, provided that Section 42, "Rules Governing
Debate, Rules Against The Chair's Participation in Debates," shall not be applicable
and the Mayor or Presiding Officer of the proceedings of the City Council shall have
the right to participate in debate in issues pending before the Council .
Section 3: It is specifically provided that all other provisions of Resolution
No. 1 shall remain in full force and effect.
Section 4: This resolution shall take effect immediately from and after its
passage by the City Council of the City of Baytown.
INTRODUCED, READ and PASSED by the affirmative vote of the City Council of the
City of Baytown on this 12th day of September 1974.
