A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS,
AUTHORIZING LOCAL SPONSORSHIP OF CORPS OF ENGINEERS' BURNET,
CRYSTAL AND SCOTT BAYS PROJECT.
WHEREAS, the United States Army Corps of Engineers has developed a plan for
reducing flood damages in the Burnet, Crystal and Scott Bays area of Baytown,
Texas; and
WHEREAS, before a report on the plan can be sent to the appropriate agencies
and to the United States Congress with a favorable recommendation, it is necessary
" for local interest, through the medium of a public body to furnish the Corps of
Engineers appropriate assurances that the requirements of local cooperation will
be met; and
WHEREAS, the City Council of Baytown, Texas , is such a public body, repre-
senting local interests; and
WHEREAS, due to changes contained in recent legislation, it has become ne-
cessary to revise and expand the local interest requirements of local cooperation;
NOW THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS:
Section 1 : That the City Council of the City of Baytown , Texas, favors the
authorization of the project as will be presented in the Corps of Engineers report.
Section 2: And further resolves that, subject to subsequent legislative
action as the City Council at the time deems appropriate, the City Council declares
its intention to furnish or cause to be furnished the following requirements of
local cooperation:
1 . Provide a cash contribution equal to twenty (20%) percent of the
final first costs of the proposed project prior to the commencement
of acquisition of any lands and improvements in the area.
2. At least annually inform affected interests regarding the limitations
of the protection afforded by the proposed project.
3. Manage the evacuated lands including policing, vector control , road
maintenance, and regulation of future use of the project area.
4. Hold and save the United States free from damages that may result
from management of the completed project.
5. Continue to enforce current land use regulations and participate
in the National Flood Insurance Program for the unevacuated portions
of the proposed project area in conformance with the National Flood
Insurance Act of 1968 and the Flood Disaster Protection Act of 1973.
Section 3: This Resolution shall take effect immediately from and after its
passage by the City Council of the City of Baytown, Texas .
