CC Resolution No. 456 RESOLUTION NO. 456 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, CONFIRMING THE DECLARATION BY THE CIVIL DEFENSE DIRECTOR WITH THE APPROVAL OF THE CITY MANAGER OF THE EXISTENCE OF AN EMER- GENCY ON THE 3TH DAY OF SEPTEMBER, 1973. WHEREAS, Section 9-3 of the Code of Ordinances of the City of Baytown provides that the Civil Defense Director may, if the City Council is not in session, with the approval of the City Manager declare the existence of an emergency subject to con- firmation by the City Council at its next meeting; and WHEREAS, as a result of tropical storm Delia, high tides caused the flooding of the Brownwood Subdivision in Baytown, Texas , with water getting into a majority of the homes in that subdivision; and WHEREAS, as a result of the aforementioned flooding, the residents of Brownwood were forced to make a hurried evacuation of their homes leaving most of their per- sonal belongings behind; and WHEREAS, after an emergency has been declared pursuant to the provisions of Section 9-3 of the Baytown Code of Ordinances, the Civil Defense Director, subject to the approval of the City Manager, becomes clothed with certain rule making and supervisory powers necessary for the protection of health, safety and property of victims of disasters ; and WHEREAS, as a result of the aforementioned flooding, evacuation, and attendant health and security problems , it was deemed necessary by the Civil Defense Director and the City Manager to declare an emergency without delay; and WHEREAS, City Council is of the opinion that an emergency as contemplated by Section 9-3 of the Code of Ordinances did, in fact exist; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN , TEXAS: Section 1 : That the City Council hereby confirms action taken by the Civil Defense Director with the approval of the City Manager in declaring the existence of an emergency on the 3rd day of September, 1973, as a result of the effects of tropical storm Delia. Section 2: Effective Date: This resolution shall take effect from and after its passage by the City Council of the City of Baytown.
