A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS ,
OFFICIALLY DESIGNATING THE TRACT OF LAND ACQUIRED BY THE CITY FROM
EDWIN RICE BROWN, INDIVIDUALLY, AS INDEPENDENT EXECUTOR OF THE
ESTATE OF MYRA CABANISS BROWN , DECEASED, AND AS TESTAMENTARY TRUSTEE
UNDER HER WILL; EDWIN RICE BROWN , INDEPENDENT EXECUTOR OF THE ESTATE
OF ADELE BROWN HARVEY, DECEASED, AND AS TESTAMENTARY TRUSTEE UNDER
HER WILL; AND MARTHA TSCHUDIN, A FEME SOLE; MYRA TSCHUDIN PARSON ,
ET VIR M. H. PARSON; GERALD BROWN HARVEY; JEOFFREY TALIAFERRO BROWN ;
MICHAEL DONOGHUE BROWN ; KATHERINE SILVERBERG, A FEME SOLE ; MYRA
SILVERBERG, A FEME SOLE; AND ANN CABANISS BROWN HEYBURN , ACTING
THROUGH THEIR AGENT AND ATTORNEY IN FACT, EDWIN R. BROWN , AS A
PUBLIC PARK AND OFFICIALLY DESIGNATING AND NAMING SUCH TRACT AS
THE MYRA C. BROWN WILD BIRD SANCTUARY AND PARK.
WHEREAS, Edwin Rice Brown, Individually, as Independent Executor of
the Estate of Myra Cabaniss Brown, Deceased, as Testamentary Trustee under her
Will ; Edwin Rice Brown, Independent Executor of the Estate of Adele Brown Harvey,
Deceased, and as Testamentary Trustee under her Will ; and Martha Tschudin, a
feme sole; Myra Tschudin Parson, et vir M. H. Parson ; Gerald Brown Harvey; Jeoffrey
Taliaferro Brown; Michael Donoghue Brown; Katherine Silverberg , a feme sole;
Myra Silverberg, a feme sole; and Ann Cabaniss Brown Heyburn, acting through
their agent and attorney in fact, Edwin R. Brown, by a deed, conveyed to the City
land situated in the Nathaniel Lynch Survey, A-44, being more particularly described
as follows , to-wit:
BEING a parcel of land out of the Nathaniel Lynch Survey, A-44, and being
a part of Lots 12, 13 and 14 of the Wooster Subdivision, recorded by plat
in Volume 65, at Page 274 and 275 of the Harris County Deed Records , Harris
County, Texas, and being more particularly described by metes and bounds,
as follows :
BEGINNING at the Point of Intersection of the West right of way line
of Steinman Avenue with the North right of way line of Shreck Avenue;
THENCE, Southwesterly with the North right of way line of Shreck Avenue
to the Point of Intersection of said right of way line with the Northeast
right of way line of Brownwood Drive;
THENCE, Northwesterly with the Northeast right of way line of Brownwood
Drive to the Point of Intersection with the Northeast lot line of Lot 18,
Block BB, Brownwood Subdivision;
THENCE, North 30°36 ' West, with the Northeast lot line of said Lot 18, a
distance of 482.5 feet, to the intersection of said lot line with the
Burnett Bay shoreline;
THENCE, Northeasterly with the meanders of Burnett Bay shoreline to the
confluence of the centerline of Fresh Water Bayou;
THENCE, Northeasterly with the meanders of centerline of said Fresh Water
Bayou to its Point of Intersection with the Southerly property line of
a tract of land conveyed to Gene B. Hazelwood by deed recorded in Volume
5152 at Page 130 in Harris County Deed Records ;
THENCE, South 60°30' East with said Southerly property line a distance
of 279.65 feet to the Point of Intersection with the West right of way
line of Steinman Avenue;
THENCE, Southerly with the West right of way line of Steinman Avenue to
the POINT OF BEGINNING, enclosing a tract of land containing 37 acres
more or less .
WHEREAS, in recognition of Myra C. Brown , the City Council desires to
officially dedicate such land for use as a wild bird sanctuary and park and de-
sires to officially name said tract; NOW THEREFORE ,
Section 1 : That the City Council hereby dedicates the tract acquired
from Edwin Rice Brown, Individually, as Independent Executor of the Estate of
Myra Cabaniss Brown, Deceased, and as Testamentary Trustee under her Will ; Edwin
Rice Brown Independent Executor of the Estate of Adele Brown Harvey, Deceased,
and as Testamentary Trustee under her Will ; and Martha Tschudin , a feme sole;
Myra Tschudin Parson, et vir M. H. Parson, Gerald Brown Harvey ; Jeoffrey Taliaferro
Brown ; Michael Donoghue Brown; Katherine Silverberg, a feme sole; Myra Silverberg,
a feme sole; and Ann Cabaniss Brown Heyburn, acting through their agent and attorney
in fact, Edwin Rice Brown, for use as a wild bird sanctuary and public park.
Section 2: That the City Council hereby officially designates and names
the above described tract of land as the MYRA C. BROWN WILD BIRD SANCTUARY AND
PARK.
Section 3: This resolution shall take effect from and after its passage
by the City Council .
INTRODUCED, READ and PASSED by the affirmative vote of the City Council
of the City of Baytown on this 14th day of June 1973.
