CC Resolution No. 441 RESOLUTION NO. 441 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN AUTHORIZING FRITZ LANHAM, CITY MANAGER, OR HIS SUCCESSOR, TO MAKE APPLICATION FOR A FEDERAL GRANT UNDER PUBLIC LAW 92-500 AND THE RULES AND RE- GULATIONS PURSUANT THERETO, AND TO SIGN THE ACCEPTANCE OF THE GRANT, WHEN MADE, AND ANY OTHER NECESSARY DOCUMENTS REQUIRED TO COMPLETE THE PROJECT ON BEHALF OF THE CITY OF BAYTOWN. WHEREAS, it is comtemplated that the City of Baytown, Texas , will con- struct certain wastewater facilities , and it is deemed necessary and proper to apply for a federal grant under the Federal Water Pollution Control Act Amend- ments of 1972, Public Law 92-500, and the rules and regulations pursuant thereto; NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN , TEXAS : Section 1 : That FRITZ LANHAM, City Manager, or his successor, is hereby authorized and directed to make application for a federal grant under Public Law 92-500 and the rules and regulations pursuant thereto, and to sign the ac- ceptance of the grant, when made, and any other necessary documents required to complete the project on behalf of the above named applicant. Section 2: BE IT FURTHER RESOLVED that the above named applicant will : (a) Provide an operation and maintenance manual for the facilities which is acceptable to the State Water Pollution Control Agency and the Environmental Protection Agency and will fulfill the tasks described therein for the proper and efficient operation and maintenance of the facilities after completion of construction. (b) Provide the necessary funds which are estimated to be approximately $100,000.00 per annum for the proper operation and maintenance of the facilities . (c) Employ qualified personnel in accordance with the recommendations or requirements of the State Water Pollution Control Agency to operate the wastewater facilities , and will require its con- sulting engineer or agent to provide certain on-the-job training for employees during start-up of the facilities . Section 3: Effective Date: This resolution shall take effect from and after its passage by the City Council of the City of Baytown, Texas.
