CC Resolution No. 391 RESOLUTION NO. 391 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN WHEREBY THE CITY OF BAYTOWN AGREES TO CONSTRUCT DRAINAGE- DIVERSION STRUCTURES ALONG NORTH MAIN STREET. WHEREAS, the property owners between North Main and Garth Road have agreed with the Planninq Comnission to construct a four-lane road with esplanade between North Main and Garth Road, said road to be known as Rollingbrook Drive , entirely at their own expense; and WHEREAS, Shindler and Associates will provide necessary easement plus temporary construction easements as needed for the construction of a drainage-diversion structure along the west side of North Main; and WHEREAS, the Harris County Flood Control District will build 300 feet of drainage-diversion structure from the existing Harris County Flood Control Ditch to the point 300 feet north of said existing ditch ; and WHEREAS , Shindler and Associates have agreed to construct a temporary drainage-diversion structure on the south side of the proposed Rollingbrook Drive which structure may be used for temporary drainage for a period not less than six months after which it may cease to be used for drainaqe at Shindler and Associates ' option; and WHEREAS , the City of Baytown acknowledges that there is a drainage problem which exists along North Main Street; and WHEREAS, it would not be prudent to build Rollingbrook Drive without the drainage problem on North Main being solved; NOW THEREFORE , BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN : Section 1 : That the City Council of Baytown, Texas , hereby agrees that the City of Baytown will begin to construct at expiration of six months from date a drainage-diversion structure for a distance of approximately 700 feet beginning at the existing drainage box at the intersection of Massey- Tompkins and North Main running south along the west side of North Main unto Y a point of intersection with the Harris County Flood Control drainage-diversion structure which is to be constructed by the Harris County Flood Control District. Section 2: This resolution shall take effect after its passage by the City Council of the City of Baytown.
