CC Resolution No. 364 RESOLUTION NO. 364 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN AUTHORIZING THE MAYOR AND CITY CLERK TO ENTER INTO A LICENSED AGREEMENT FOR THE EXTENSION OF THE CITY'S WATER PIPE LINE THROUGH THE EXISTING RIGHT-OF-WAY OF THE MISSOURI PACIFIC RAILROAD AND SOUTHERN PACIFIC RAILROAD. WHEREAS, the City of Baytown is desirous of extending and improving its present water system, and WHEREAS, said extension requires the City to cross the existing right-of-way of the Missouri Pacific and Southern Pacific Railroads , and WHEREAS, the Missouri Pacific Railroad has tendered a licensed agreement to the Cith thereby authorizing the City to cross its right-of-way and further providing for a payment of a One Hundred and No/100 ($100.00) Dollars fee for said license, and WHEREAS, the Southern Pacific Railroad has tendered the City a licensed agreement authorizing the City to cross its existing right-of-way and further providing for a payment of a Fifty and No/100 ($50.00) Dollars fee for said license. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN , TEXAS: Section 1 : That the Mayor and City Clerk of the City of Baytown are hereby authorized to enter into a licensed agreement with the Missouri Pacific Railroad for the crossing of their existing right-of-way with a twelve (12) inch water line. The location of said crossing is described in the licensed agreement as follows , to-wit: BEING approximately located 2,244 feet west of Mile Post 32, Harris County, Texas , near Baytown. The City is further authorized to pay any and all fees necessary for the execution of this agreement. Section 2: The Mayor and City Clerk of the City of Baytown are hereby authorized to enter into a licensed agreement with the Southern Pacific Railroad for the cross of their existing right-of-way with a twelve (12) inch water line. The location of said crossing is described in the licensed agreement as follows , to-wit: A 12-inch water pipeline crossing railroad 's property and under its Baytown Branch main track at Engineer's Station 1273+02 (Mile Post 24.11 ) , at or near Baytown, Harris County, Texas. The City is further authorized to pay all necessary fees for the execution and filing of this agreement.
