CC Resolution No. 351 RESOLUTION NO. 351 A RESOLUTION ABANDONING THE ANNEXATION PROCEDURE OF CERTAIN PROPERTY INSTITUTED ON THE. 8TH DAY OF APRIL, 1971 , AND PROVIDING FOR AN EFFECTIVE DATE HEREOF . WHEREAS, on the 25th day of March, 1971, the City Council of the City of Baytown by affirmative vote passed Ordinance No. 1085 setting the date of April 8 , 1971 , at 6 :45 o ' clock p.m. in the City Council Chamber of the City Hall of the City of Baytown, Texas, as the date , time and place for a public hearing on the proposed annexation by the City of Baytown, Texas , the following described property to-wit: BEGINNING at a point on the most northeasterly portion of the existing City limit line of the City of Baytown, said point being more fully described as the point of intersection of the easterly right-of-way line of State Highway 146 and the west bank of Cedar Bayou Stream; THENCE, in a northerly direction along the east right of way line of State Highway 146 to a point, said point being the intersection of the east right of way line of State Highway 146 and the southerly right of way line of Farm Market Road 565; THENCE, in a northeasterly direction along the southeasterly right of way line of the Farm Market Road 565 to a point for corner on the southwesterly right of way line of the Farm Market Road 2354 ; THENCE, in a southerly direction along the Farm Market Road 2354 to a point for corner on the Northerly line of the Houston Lighting and Power Company discharge canal; THENCE, in a westerly direction along the north line of the Houston Lighting and Power Company discharge canal to a point, said point being the intersection of the northerly line of the discharge canal and most easterly property line of the Houston Lighting and Power Company Plant; THENCE, in a northerly direction along the most easterly property line of the Houston Lighting and Power Company Plant to a point, said point being the most northeasterly corner of the Houston Lighting and Power Company Property; THENCE, in a westerly direction along the most northerly property line of Houston Lighting and Power Company to a point on the east bank of Cedar Bayou Stream; THENCE , continuing along the projection of the Houston Lighting and Power Company' s most northerly property line to a point on the west bank of Cedar Bayou Stream, said point being in the most westerly City limit line of the City of Baytown ; THENCE, in a northerly direction along the west bank of Cedar Bayou Stream, said west bank being the existing Baytown City limit line , to the point of intersection of the easterly right of way line of State Highway 146 and the West bank of Cedar Bayou Stream, said point being the POINT OF BEGINNING. WHEREAS , on the 8th day of April , 1971, at 6 : 45 o'clock p.m. in the City Council Chamber of the City Hall of the City of Baytown, Texas . The City Hall held a public hearing giving all interested parties the right to appear and be heard on the proposed annexation by the City of Baytown, Texas, of the above described property; and WHEREAS , the City Council of the City of Baytown, Texas, subsequently determined that the proposed annexation of the above described property was not necessary or desirable at that time and declined to take further action on the annexation of said territory; and WHEREAS, the City Council of the City of Baytown is still of the opinion that the annexation of said territory is not necessary or desirable. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS : Section 1 : That the proposed annexation instituted on the 8th day of April, 1971 at 6 : 45 o 'clock p.m. by public hearing in the City Council Chamber of the City Hall of the City of Baytown, Texas , is not necessary or advisable ; and Section 2 : That said proposed annexation on the fol- lowing described property is hereby abandoned for all purposes, to-wit : BEGINNING at a point on the most northeasterly portion of the existing City limit line of the City of Baytown, said point being more fully described as the point of intersection of the easterly right-of-way line of State Highway 146 and the west bank of Cedar Bayou Stream; THENCE, in a northerly direction along the east right of way line of State Highway 146 to a point, said point being the intersection of the east right of way line of State Highway 146 and the southerly right of way line of Farm Market Road 565 ; THENCE, in a northeasterly direction along the southeasterly right of way line of the Farm Market Road 565 to a point for corner on the southwesterly right of way line of the Farm Market Road 2354 ; THENCE, in a southerly direction along the Farm Market Road 2354 to a point for corner on the Northerly line of the Houston Lighting and Power Company discharge canal; THENCE, in a westerly direction along the north line of the Houston Lighting and Power Company discharge canal to a point, said point being the intersection of the northerly line of the discharge canal and the most easterly property line of the Houston Lighting and Power Company Plant; THENCE, in a northerly direction along the most easterly property line of the Houston Lighting and Power Company Plant to a point, said point being the most northeasterly corner of the Houston Lighting and Power Company Property; THENCE, in a westerly direction along the most northerly property line of Houston Lighting and Power Company to a point on the east bank of Cedar Bayou Stream; THENCE, continuing along the projection of the Houston Lighting and Power Company ' s most northerly property line to a point on the west bank of Cedar Bayou Stream, said point being in the most westerly City limit line of the City of Baytown ; THENCE, in a northerly direction along the west bank of Cedar Bayou Stream, said west bank being the existing Baytown City limit line, to the point of intersection of the easterly right of way line of State Highway 146 and the West bank of Cedar Bayou Stream, said point being the POINT OF BEGINNING. Section 3 : This resolution shall take effect from and after its passage by the City Council of the City of Baytown.
