A UNANIMOUS RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF BAYTOWN , TEXAS , GIVING FORMAL ASSURANCES
OF ITS INTENT TO COMPLY WITH LAND MANAGEMENT AND
USE CRITERIA SET FORTH IN PART 1910-CRITERIA FOR
LAND MANAGEMENT AND USE , UNDER TITLE 24 , CHAPTER
VII , SUBCHAPTER B, OF THE NATIONAL FLOOD INSURANCE
PROGRAM ; FORMALLY AUTHORIZING AND DIRECTING THE
MAYOR AND CITY CLERK TO EXECUTE THIS RESOLUTION
FOR AND ON BEHALF OF THE CITY COUNCIL ; DIRECTING
THE CITY MANAGER TO FORWARD DUPLICATE CERTIFIED
COPIES OF THIS RESOLUTION TO THE FLOOD INSURANCE
ADMINISTRATOR AND THE TEXAS WATER DEVELOPMENT
BOARD ; AND PROVIDING FOR THE EFFECTIVE DATE HEREOF .
WHEREAS , the National Flood Insurance Act of 1968
was passed by Congress to meet the needs of providing in-
surance in flood-prone areas , which over the years private
industry has been unable to meet without assistance ; and
WHEREAS , certain areas of the City of Baytown have
been continually plagued by flooding , causing the residents
of such areas to suffer extensive losses for which there
has been either no or inadequate insurance protection ; and
WHEREAS , the City Council of the City of Baytown ,
by Resolution No . 250 , adopted on the 4th day of April , 1969 ,
previously evidenced its positive interest in participating
in the said Federal program; and
WHEREAS , as a condition for insurance availability
under the said Act , a local government must give satisfactory
assurances of an intent to comply with land management and
use criteria , meeting the requirements of the said Act ; and
WHEREAS , the City Council of the City of Baytown
is desirous of taking all official actions necessary to
satisfy the requirements and conditions for the issuance of
flood insurance under the said Act; NOW THEREFORE ,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
BAYTOWN , TEXAS :
Section l : That the City Council of the City of
Baytown , Texas , hereby officially affirms , declares , and
gives assurances of its intent to comply with all require-
ments of the National Flood Insurance Act , to include the
intent to comply with land management and use criteria set
forth in Part 1910-Criteria for Land Management and Use ,
under Title 24 , Chapter VII , Subchapter B , of the National
Flood Insurance Program. To this end , the City Council
hereby gives its assurances that it will :
(a ) Recognize and evaluate flood hazards in all
actions relating to land use in the flood plain
areas having special flood hazards , ( b ) Enact no
later than December 31 , 1971 , and maintain in
force for those areas , land use and control measures
with effective enforcement provisions consistent
with the criteria set forth in Subpart B of the
said Part 1910 , ( c ) Cooperate with neighboring
jurisdictions with respect to adjoining drainage
areas and flood plains in order to prevent the
aggravation of the flooding problem in the lower
flood plain areas , and ( d) Appoint or designate
an official of the City with the responsibility ,
authority, and means to implement the commitments
hereby made in this resolution .
Section 2 : The City Council hereby further evi -
dences its intention to comply in all respects with any and
all other procedures of the National Flood Insurance Act
of 1968, as presently constituted or hereafter amended .
Section 3 : That the Mayor is hereby authorized
and directed to execute , and the City Clerk to attest ,
this resolution , for and on behalf of the City Council of
the City of Baytown , Texas .
Section 4: That the City Manager is directed to
forward duplicate certified copies of this resolution to
Mr . George K. Bernstein , Federal Insurance Administrator ,
Department of Housing and Urban Development , 451 Seventh
Street , S . W . , Washington , D . C . 20410 , together with a
certified copy to the Texas Water Development Board .

Section 5: Effective Date : That this resolution
shall take effect from and after the date of its passage by
the City Council of the City of Baytown .
INTRODUCED , READ and PASSED by the unanimous vote
of the City Council of the City of Baytown this 22nd day of
January, 1970.
