CC Resolution No. 275 RESOLUTION NO . 275 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN DETERMINING THE NECESSITY TO EXECUTE CURRENT CONTRACTS WITH HARRIS AND CHAMBERS COUNTIES CONCERNING USE OF THE CITY ' S FIRE PROTECTION AND FIRE FIGHTING EQUIPMENT ; RE- QUESTING THE COMMISSIONER ' S COURT OF THE RES- PECTIVE COUNTIES TO REIMBURSE THE CITY FOR SUCH SERVICE ON AN ACTUAL COST BASIS ; AUTHO- RIZING THE MAYOR TO EXECUTE AND THE CITY CLERK TO ATTEST THIS RESOLUTION BY AND ON BEHALF OF THE CITY COUNCIL ; AND DIRECTING THE CITY MANAGER TO FORWARD CERTIFIED COPIES OF THIS RESOLUTION TO THE COMMISSIONER ' S COURTS OF THE RESPECTIVE COUNTIES . WHEREAS , the City of Baytown has for many years provided fire protection for areas in Harris and Chambers Counties outside the corporate limits of the City ; and WHEREAS , from 1962 through 1968, the City of Baytown assisted in the fighting of three hundred twenty (320) fires in such areas , averaging 2 . 5 fires per month ; and WHEREAS , from January 1 through September 30 , 1969 , the City assisted with the fighting of forty-four (44) fires , or an increased average of 4 . 8 per month ; and WHEREAS , thirty-seven (37 ) of such fires fought during 1969 were in Harris County , and seven ( 7) were in Chambers County; and WHEREAS , the average cost of each of the fires fought in Harris County is Eighty-seven and 70/100 ($87 . 70) Dollars , which would yield an annual projected total sum of Four Thousand Two Hundred Ninety-seven and 30/100 ($4 ,297 . 30) Dollars ; and WHEREAS , the average cost of fires fought in Chambers County during such period is Seventy-nine and 78/100 ($79 . 78) Dollars , which would yield an annual projected total sum of Seven Hundred Eighteen and 02/100 ($718. 02) Dollars ; and WHEREAS , under the provisions of Article 235la-1 , V .A.T . S . , the City may contract with the Commissioner ' s Court of any county for the use of the fire trucks and other fire fighting equipment of the City in such county; and WHEREAS , such a contract was previously entered into between Harris County and the City of Baytown , with the City receiving Six Hundred ($600 . 00) Dollars per year for the services provided under such contract; and WHEREAS , no contract has ever been entered into between Chambers County and the City for the furnishing of such fire protection services in Chambers County ; NOW THEREFORE , BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN , TEXAS: Section 1 : That the City Council of the City of Baytown deems it necessary to have current contracts exe- cuted with Harris and Chambers Counties concerning the use of the City ' s fire protection and fire fighting equipment in such counties , outside of the corporate limits . Section 2 : The City Council hereby goes on record as requesting the Commissioner ' s Courts of the respective counties to reimburse the City for its cost in providing this service on a monthly basis , said monthly cost to be determined by the City ' s actual experience data . Section 3 : That the Mayor is hereby authorized and directed to execute and the City Clerk to attest this resolution by and on behalf of the City Council of the City of Baytown. Section 4 : The City Manager is hereby directed -2- to forward certified copies of this resolution to the Com- missioner ' s Courts of the respective counties .
