CC Resolution No. 273 RESOLUTION NO . 273 RESOLUTION AND ORDER CANVASSING RETURNS AND DECLAR- ING RESULTS OF SPECIAL ELECTION HELD IN THE CITY OF BAYTOWN , TEXAS , ON SEPTEMBER 23 , 1969 , ON THE QUES- TION OF ADOPTION OF A ONE PERCENT ( 1 %) LOCAL SALES AND USE TAX WITHIN SAID CITY . WHEREAS , there was held in the City of Baytown , Texas , on the 23rd day of September , 1969 , an election at which there were submitted to the duly qualified resident electors of said City, for their action thereupon , the fol - lowing propositions : FOR adoption of a one percent ( 1 %) local sales and use tax within the City . AGAINST adoption of a one percent ( 1 %) local sales and use tax within the City; and WHEREAS , there were cast at said election 3 ,652 votes , of which number there were cast: FOR adoption of a one percent ( 1 %) local sales and use tax within the City . 2 ,050 votes AGAINST adoption of a one percent ( 1 %) local sales and use tax within the City. 1 ,602 votes Majority FOR adoption of a one percent ( 1 %) local sales and use tax within the City . 448 votes as shown in the official election returns heretofore lawfully submitted to the City Council of the City of Baytown , Texas , and filed with the City Clerk of said City ; and WHEREAS , only duly qualified resident electors of said City voted at said election , and said election was called and held in strict conformity with the laws of the State of Texas ; and WHEREAS , by Resolution No . 272 , adopted by the City Council on the 25th day of September , 1969 , the City Council officially canvassed the results of the said election, and officially and affirmatively declared that the One Percent (1 %) Local Sales and Use Tax within said City had been properly and lawfully adopted in accordance with the provisions of law, said canvassing having been conducted so as to comply with the provisions of Section 2 ( I) of Article 1066c , Vernon ' s Texas Civil Statutes ; and WHEREAS , the City Charter requires the results of regular City elections to be canvassed by the City Council on the second Wednesday next following such elections ; and WHEREAS , to avoid any legal dispute as to the pro- per date for the canvassing of the election returns , the City Council desires to recanvass the returns of the elec- tion so as to coincide with the date established by the City Charter for City elections ; NOW , THEREFORE , BE IT RESOLVED AND ORDERED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN , TEXAS : Section 1 : That the election described in the preamble to this resolution and order was duly called and notice thereof given in accordance with law ; that said election was held in the manner required by law ; that only duly qualified resident electors of the City of Baytown , Texas , voted at said election ; that due returns of said election have been made by the proper officers ; that said election resulted favorably to the proposition : FOR ADOPTION OF A ONE PERCENT ( 1 %) LOCAL SALES AND USE TAX WITHIN THE CITY ; and that a majority of the qualified voters of said City of Baytown , Texas , voting at said election , have voted in favor of approving and adopting a One Percent (1 %) Local Sales and Use Tax within said City. Section 2 : That the City Council of the City of Baytown , Texas , hereby officially and affirmatively de- clares that said One Percent ( 1 %) Local Sales and Use Tax -2- within said City has been properly and lawfully adopted in accordance with the provisions of Article 1066c , Vernon ' s Texas Civil Statutes (Acts 1967 , 60th Legislature , Regular Session , Chapter 36 , Page 62 , as amended) . Section 3 : That the City Clerk is hereby autho- rized and directed to transmit to the Comptroller of Public Accounts of the State of Texas , in Austin , Texas , by United States Registered Mail , or by United States Certified Mail , a certified copy of this Resolution and Order Canvassing the Returns of Special Election , under the official seal of the City of Baytown , Texas , showing the approval of said Local Sales and Use Tax by the qualified voters of said city , to- gether with a map of said city , clearly showing the boundaries thereof as of the date of said election . INTRODUCED, READ and PASSED by the affirmative vote of the members of the City Council of the City of Baytown , on this 1st day of October , 1969 .
