CC Resolution No. 258 RESOLUTION NO . 258 RESOLUTION AND ORDER CANVASSING RETURNS AND DE- CLARING RESULTS OF SPECIAL ELECTION HELD IN THE CITY OF BAYTOWN , TEXAS ON MAY 20 , 1969 , ON THE QUESTION OF ADOPTION OF A COMPREHENSIVE ZONING ORDINANCE . WHEREAS , there was held in the City of Baytown , Texas , on the 20th day of May , 1969 , an election at which there was submitted to the duly qualified resident electors of said City , for their action thereupon , the following pro- position: SHALL THE CITY OF BAYTOWN ADOPT A COMPREHENSIVE ZONING ORDINANCE? "FOR adoption at this election , under the power of referendum provided in the City Charter, of the proposed comprehensive Zoning Ordinance for the City of Baytown . " "AGAINST adoption at this election , under the power of referendum provided in the City Charter, of the proposed comprehensive Zoning Ordinance for the City of Baytown . " WHEREAS , there were cast at said election 4,322 votes , of which number there were cast: " FOR adoption at this election , under the power of referendum provided in the City Charter, of the proposed comprehensive Zoning Ordinance for the City of Baytown . " 1345 votes "AGAINST adoption at this election , under the power of referendum provided in the City Charter, of the proposed comprehensive Zoning Ordinance for the City of Baytown . " 2977 votes Majority AGAINST adoption of comprehensive Zoning Ordinance for the City of Baytown. 1632 votes as shown in the official election returns heretofore lawfully submitted to the City Council of the City of Baytown , Texas , and filed with the City Clerk of said City ; and WHEREAS , only duly qualified resident electors of said City voted at said election , and said election was called and held in strict conformity with the laws of the State of Texas ; NOW THEREFORE , BE IT RESOLVED AND ORDERED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN , TEXAS : Section 1 : That the election described in the preamble to this resolution and order was duly called and notice thereof given in accordance with law; that said elec- tion was held in the manner required by law; that only duly qualified resident electors of the City of Baytown , Texas voted at said election ; that due returns of said election have been made by the proper officers ; that said election resulted in the defeat of the proposed comprehensive Zoning Ordinance and that a majority of the qualified voters of oil said City of Baytown, Texas , voting at said election , have voted against the adoption of the proposed Zoning Ordinance . Section 2: That the City Council of the City of Baytown , Texas , hereby officially and affirmatively declares that the proposed said comprehensive Zoning Ordinance has been defeated in the Special Election held under the power of referendum provided in Section 98 of the City Charter, by a majority of the votes cast in said election .
