CC Resolution No. 251 RESOLUTION NO. 251 A RESOLUTION CANVASSING THE RETURNS OF THE REGULAR MUNICIPAL ELECTION HELD WITHIN THE CITY OF BAYTOWN ON THE 1ST DAY OF APRIL, 1969 , FOR THE PURPOSE OF ELECTING A MAYOR FROM THE CITY AT LARGE AND THREE (3) COUNCILMEN FROM THE RESPECTIVE DISTRICTS NOS. TWO (2) , THREE (3) AND SIX (6) TO SERVE REGULAR TWO YEAR TERMS AND FOR THE PURPOSE OF ELECTING TWO (2) COUNCILMEN FROM THE RESPECTIVE DISTRICTS NOS. FOUR (4) AND FIVE (5) TO FILL UNEXPIRED TERMS; DECLARING THE RESULTS OF SAID ELECTION; FINDING THAT NOTICE OF SAID ELECTION WAS DULY AND PROPERLY GIVEN AND THAT SAID ELECTION WAS PROPERLY HELD AND THE RETURNS THEREOF MADE BY THE PROPER OFFICIALS IN ACCORDANCE WITH THE LAWS OF THE STATE OF TEXAS. WHEREAS , pursuant to Article IX, Section 96 of the Charter of the City of Baytown, the City Council of said City, at a special meeting held on this 9th day of April, 1969 , proceeded, as required by law, to canvass the returns of the Regular Municipal Election held in the City of Baytown on the 1st day of April, 1969 , for the purpose of electing a Mayor from the City at large and three (3) coun- cilmen from the respective Districts Nos . Two (2) , Three (3) and Six (6) for the purpose of electing two (2) councilmen from the respective Districts Nos . Four (4) and Five (5) to fill unexpired terms ; said election having been held under and pursuant to the provisions of the Charter of said City and an ordinance duly passed on the 23rd day of January, 1969 , calling said Election; and WHEREAS , said Election having been duly and regu- larly had and held as called in said Ordinance and according to law, and the returns thereof having been duly made and the Election Judges having certified the results of said Election, as hereinafter set out, and the City Council having duly and regularly canvassed the returns of said Election and finding that the total votes cast at said Election were as follows , to-wit: FOR MAYOR (FROM CITY AT LARGE) Albert Fanestiel 1303 Votes Glen Walker 2504 Votes A. M. Braswell 1231 Votes FOR COUNCILMAN DISTRICT NO. 2 Abe M. Simon 2112 Votes David W. Evans 2274 Votes FOR COUNCILMAN DISTRICT NO. 3 Don M. Hullum 3605 Votes J. W. "Bill" Thornton 1175 Votes FOR COUNCILMAN DISTRICT NO. 6 William Glenn Smith 1487 Votes Lamar Kelley 3340 Votes FOR COUNCILMAN DISTRICT NO. 4 (Unexpired Term) Kathleen C. Hall 660 Votes Ronald E . Roberts 1674 Votes Leonard W. Stasney 2488 Votes FOR COUNCILMAN DISTRICT NO. 5 (Unexpired Term) Jim Bailey 1799 Votes James Allen Cannon 2708 Votes AND WHEREAS , the City Council of the City of Baytown finds the Election returns as set out above to be accurate and correct and no Election protest or contest having been filed with said Council or instituted in connection with said Election; NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS : Section 1: That as shown above , no candidate re- ceived a majority of the votes cast at said Election for the office of Mayor from the City at large , and accordingly, it -2- is necessary that a Run-Off Election be held to elect a Mayor; and it appearing that ALBERT FANESTIEL and GLEN WALKER are the two candidates receiving the highest number of votes at said Election for the office of Mayor from the City at large , it is , therefore, ORDERED that a Special Run-Off Election be held for the purpose of electing one of these candidates for said office. Section 2 : That DAVID W. EVANS received a majority of the votes cast at said Election for the office of Councilman from District No. 2 and, accordingly, District No. 2 of the City of Baytown . Section 3 : That DON M. HULLUM received a majority of the votes cast at said Election for the office of Coun- cilman from District No. 3 and, accordingly, District No. 3 of the City of Baytown. Section 4 : That LAMAR KELLEY received a majority of the votes cast at said Election for the office of Coun- cilman from District No. 6 and, accordingly, District No. 6 of the City of Baytown. Section 5 : That LEONARD W. STASNEY received a majority of the votes cast at said Election for the office of Councilman from District No. 4 and, accordingly, District No. 4 of the City of Baytown. Section 6 : That JAMES ALLEN CANNON received a majority of the votes cast at said Election for the office of Councilman from District No. 5 and, accordingly, District No. 5 of the City of Baytown. Section 7 : That the City Council of the City of Baytown further finds that the notice of said Election was -3- duly and properly given as required by law and as provided in the Ordinance calling said Election and that said Election was duly and regularly held and the returns thereof duly and regularly made by the proper officials of said Election, and in all things according to law. INTRODUCED, READ and PASSED by the affirmative vote of the City Council of the City of Baytown on this 9th day of April, 1969 .
