A UNANIMOUS RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF BAYTOWN FORMALLY RECOGNIZING THE PUBLIC
NEED FOR ADEQUATE FLOOD INSURANCE TO PROTECT THE
MANY RESIDENCES IN FLOOD-PRONE AREAS; DIRECTING
THE PLANNING AND LEGAL DEPARTMENTS TO UNDERTAKE
THE CONSIDERATION OF CERTAIN LAND USE AND CONTROL
REGULATIONS CONCERNING AREAS EXPOSED TO FLOOD
DAMAGE; VOICING THE WILLINGNESS OF THE CITY COUN-
CIL TO CONSIDER THE INSTITUTION OF ALL OFFICIAL
ACTIONS NECESSARY TO CARRY OUT THE OBJECTIVES OF
THE NATIONAL FLOOD INSURANCE ACT OF 1968; AND AU-
THORIZING THE MAYOR AND CITY CLERK TO EXECUTE THIS
RESOLUTION, AND DIRECTING THE CITY MANAGER TO FOR-
WARD A CERTIFIED COPY OF SAME TO THE FEDERAL IN-
SURANCE ADMINISTRATOR, DEPARTMENT OF HOUSING AND
URBAN DEVELOPMENT.
WHEREAS , the National Flood Insurance Act of
1968 has been passed by Congress , designed to meet the
need of providing insurance in flood-prone areas , which
over the years private industry has been unable to meet
without assistance; and
WHEREAS , pursuant to such Federal legislation,
the Secretary of Housing and Urban Development has proposed
certain standards , requirements and criteria for eligibility
by states and local areas for flood insurance coverage un-
der the said Act, and the grounds for priority in the con-
duction of rate making studies and investigations ; and
WHEREAS, priority in conducting such studies and
investigations shall be given to those areas evidencing a
positive interest in securing flood insurance coverage un-
der the program; and
WHEREAS , certain areas of the City of Baytown
have been continually plagued by flooding, causing the residents
of such areas to suffer excessive losses for which there has
been either no or inadequate insurance protection; and
WHEREAS , the City Council of the City of Baytown
is desirous of indicating the requisite evidence of positive
interest in the said program, and is further desirous of
determining procedures and requirements necessary for be-
coming eligible for such program; NOW THEREFORE ,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
BAYTOWN:
Section l: That the City Council of the City
of Baytown formally recognizes the public need for adequate
flood insurance to protect the many residences in the flood-
prone areas within the City.
Section 2 : That the Planning and Legal Departments
are hereby directed to formulate land use and control regu-
lations pertaining to areas within the City of Baytown which
are exposed to flood damage , with a view towards the development
of proposed construction away from locations which are flood-
prone.
Section 3 : That the City Council of the City of
Baytown hereby formally voices its willingness to take all
official actions as may be necessary to carry out the objec-
tives of the said Federal program.
Section 4: That the Mayor and City Clerk are
hereby authorized and directed to execute this resolution,
and the City Manager is directed to forward a certified
copy of same to the Federal Insurance Administrator, De-
partment of Housing and Urban Development, 451 Seventh Street,
S.W. , Washington, D. C. 20410 .
