CC Resolution No. 245 RESOLUTION NO. 245 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN FORMALLY APPROVING A JOINT AGREEMENT BETWEEN THE CITY OF BAYTOWN AND THE CITY OF MONT BELVIEU APPORTIONING THE EXTRATERRITORIAL JURISDIC- TION OF THE TWO CITIES AND AGREEING UPON A COMMON BOUNDARY LINE BETWEEN THE EXTRATERRITORIAL JURISDICTION OF THE TWO CITIES; AU- THORIZING AND DIRECTING THE MAYOR AND CITY CLERK TO EXECUTE AND ATTEST THE JOINT AGREEMENT; AND DIRECTING THE CITY ATTORNEY TO FORWARD A CERTIFIED COPY TO THE CITY OF MONT BELVIEU FOR RECI- PRICAL APPROVAL. WHEREAS, the City of Baytown has heretofore annexed certain territory in Chambers County, Texas, to include a ten (10) foot strip east of Cedar Bayou extending northerly along the Southern Pacific Railroad right-of-way to its junction Farm-Market Road 1942, and thence westerly Farm-Market Road 1942 to its junction with Cedar Bayou; and WHEREAS, by the annexation of such additional territory, the extra- territorial jurisdiction of the City of Baytown expanded in conformity with such annexation, and comprised an area around the said additional territory of two miles in all directions; and WHEREAS, the annexation of such territory and the extension of the extraterritorial jurisdiction of the City of Baytown in the area has hereto- fore restricted the extension of the extraterritorial jurisdiction of the City of Mont Belvieu, to=wit: south and west; and WHEREAS, the City Council of the City of Mont Belvieu heretofore formally requested that the City of Baytown disannex a portion of its ten (10) foot strip along the Southern Pacific Railroad right of way, which said territory has been disannexed and excluded from the boundary limits of the City of Baytown by final action heretofore taken; and WHEREAS, the City Council of the City of Mont Belvieu has further requested that the City of Baytown enter into a written agreement agreeing upon a common boundary line between the extraterritorial jurisdiction of the two cities, and that the City of Mont Belvieu be apportioned a part of the City of Baytown 's previous exclusive extraterritorial jurisdiction; and WHEREAS, the City Attorney of the City of Baytown has drawn a proposed agreement to be executed by the respective cities , agreeing upon the westerly boundary line of the Chambers County Water and Improvement District No. 1 southerly along Cedar Bayou from the southwest corner of said water district to the junction of Cedar Bayou with State Highway No. 73 thence easterly along the northerly right of way line of State Highway No. 73 to its junction with Farm-Market Road 2354; and WHEREAS, the City Council of the City of Baytown has approved said agreement, and desires to empower its mayor to formally execute the said agreement as the act and deed of the governing body of the City of Baytown; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: Section 1 : That the aforesaid agreement is hereby officially ap- proved as drafted by the City Attorney, and the Mayor and City Clerk are hereby authorized and directed to execute and attest the same as the official act and deed of the City Council of the City of Baytown. Section 2: The City Attorney is hereby directed to forward a cer- tified copy of this resolution, together with two signed copies of the afore- mentioned agreement, to the City Attorney of the City of Mont Belvieu for such City's reciprical approval . Section 3: The Mayor and City Clerk are hereby authorized and directed to execute this resolution and the City Manager is directed to forward a certified copy of same to the City of Mont Belvieu. INTRODUCED, READ and PASSED by the affirmative vote of the City Council of the City of Baytown on this the 13 day of March, 1969.
