A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
BAYTOWN AGREEING TO AND OBLIGATING ITSELF TO AS-
SUME THE PAYMENT OF A PORTION OF THE ANNUAL EX-
PENSES OF OPERATING AND MAINTAINING CERTAIN COM-
MUNITY BUILDINGS TO BE CONSTRUCTED BY THE HOUSING
AUTHORITY OF THE CITY OF BAYTOWN; PROVIDING THAT
THE CITY'S OBLIGATIONS TO PAY SAID EXPENSES SHALL
NOT EXCEED THE AMOUNT PAID ANNUALLY BY THE HOUSING
AUTHORITY TO THE CITY OF BAYTOWN IN THE FORM OF
PAYMENTS IN LIEU OF TAXES, OR THE SUM OF TWO THOUSAND
AND N0/100 ($2 ,000 .00) DOLLARS, WHICHEVER SUM SHALL
BE THE LESSER; AUTHORIZING THE MAYOR AND CITY CLERK
TO EXECUTE THIS RESOLUTION AND DIRECTING THE CITY
MANAGER TO FORWARD A CERTIFIED COPY OF SAME TO THE
HOUSING AUTHORITY OF THE CITY OF BAYTOWN.
WHEREAS , the Housing Authority of the City of
Baytown is presently engaged in planning the construction,
with the assistance of the Housing and Urban Development
Agency of the United States , of two (2) Community Buildings
for the Housing Authority communities situated in this City;
and
WHEREAS , said Housing Authority proposes to pro-
vide in said buildings space for community facilities and
has agreed to provide the basic furniture , including but
not limited to stoves , refrigerators , ovens and other major
cooking equipment in kitchens equipped with sufficient cabi-
nets , counters and storage space as well as sufficient tables
and chairs for the proper utilization of such space for
such purpose; and
WHEREAS, the construction of such Community Build-
ings and the allocation of money by the Housing and Urban
Development Agency of the United States for such purposes is
conditioned upon the assumption by the City, other political
subdivisions and local service groups, of at least a portion
of the costs of operating such facilities , the Housing Authority
being prohibited from bearing any part of such expense; and
WHEREAS , the available of such Community Buildings
for such use by the citizens of this community would be of
great benefit to this City and its citizens; NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
BAYTOWN, TEXAS :
Section 1: That the City of Baytown, in considera-
tion of the undertaking by the Housing Authority of the City
of Baytown as above stipulated, agrees and hereby obligates
itself to assume the payment of a portion of the annual ex-
penses of operating and maintaining the said Community Build-
ings not borne by other political subdivisions , private ser-
vice groups or foundations , the Office of Economic Opportunity,
Federal grants or the Governor's Committee for the Aged, but
in no event to exceed the sum paid annually by the Housing
Authority to the City of Baytown in the form of payments in
lieu of taxes , or the sum of TWO THOUSAND AND NO/100 ($2 ,000 .00)
DOLLARS, whichever sum shall be the lesser.
Section 2 : That the obligation of the City of
Baytown to bear such expenses shall not constitute a general
obligation of the City, but shall be restricted to and dis-
charged out of the payments in lieu of taxes paid annually
to the City of Baytown by the said Housing Authority on its
property situated in this City.
Section 3: That the obligations hereby assumed
by the City shall become effective upon the completion of
the said Community Buildings and the furnishing of the faci-
lities hereinabove provided for, such anticipated completion
date to be on or soon after June 30 , 1969 .
Section 4: That the Mayor and City Clerk are
hereby authorized and directed to execute this resolution
and the City Manager is directed to forward a certified

copy of same to the Housing Authority of the City of Baytown.
INTRODUCED, READ and PASSED by the affirmative
vote of the members of the City Council of the City of
Baytown, this 13th day of February, 1969 .
