CC Resolution No. 235 RESOLUTION NO. 235 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN MAKING CERTAIN RECOMMENDATIONS AND EX- PRESSING ITS VIEWS TO THE TEXAS WATER QUALITY BOARD CONCERNING THE ISSUANCE OF A PERMIT BY THE BOARD TO UNITED STATES STEEL CORPORATION FOR THE DISCHARGE OF INDUSTRIAL WASTE WATER AND TREATED DOMESTIC SEWAGE INTO CEDAR BAYOU AND GALVESTON BAY; AUTHORIZING AND DIRECTING THE MAYOR AND CITY CLERK TO EXECUTE THIS RESOLUTION AND DIREC- TING THE CITY MANAGER TO FORWARD A CERTIFIED COPY OF SAME THEREOF TO THE TEXAS WATER QUALITY BOARD. WHEREAS , United States Steel Corporation has applied for a permit from the Texas Water Quality Board to discharge industrial waste water and treated domestic sewage from its steel mill located on Cedar Bayou in Chambers County, Texas ; and WHEREAS, a public hearing on the said application has been called by the Texas Water Quality Board to consider the effects of the proposed waste discharge on the water qua- lity in Cedar Bayou and Galveston Bay, and to determine the conditions under which a permit may be granted; and WHEREAS , the City of Baytown is aware of the powers and responsibilities placed upon it as an incorporated city under the provisions of the Texas Water Quality Act of 1967, with respect to the discharge of effluent into public waters within its area; and WHEREAS , the City Council of the City of Baytown is cognizant of its authority to make recommendations con- cerning water quality criteria for public waters within its area, and is desirous of expressing its views towards the granting of the requested permit; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: Section 1: That the City of Baytown, from its review of the planned initial operations of United States Steel Corporation, to include its initial demands for the use and disposal of industrial waste water and treated do- mestic sewage, and its understanding of the treatment faci- lities to be employed, has no objections to the granting of a permit to cover the disposal of approximately 5,000 ,000 gallons per day into Cedar Bayou. Section 2 : That the City Council of the City of Baytown recommends that the Texas Water Quality Board give close scrutiny to subsequent requests for the disposal of additional waste water into Cedar Bayou and Galveston Bay, at least until United States Steel Corporation can define the operations ultimately contemplated and describe the treat- ment facilities to be employed. Section 3 : That the Mayor and City Clerk are hereby authorized and directed to execute this resolution and the City Manager is directed to forward a certified copy of same to the Texas Water Quality Board.
