CC Resolution No. 229 RESOLUTION NO. 229 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN AUTHORIZING AND DIRECTING THE MAYOR TO EXECUTE, FOR AND IN THE NAME OF THE CITY, A DEED CONVEYING A CERTAIN .2547 ACRE TRACT OF LAND TO S . V. ROBBERSON, G. C. LANNOU AND B. B. ELLIOTT, TRUSTEES FOR BAYTOWN VOLUNTEER FIRE DEPARTMENT STATION NO. I ; INSTRUCTING THE CITY ATTORNEY TO PREPARE AN APPROPRIATE DEED FOR THE CONVEYANCE OF SAID PROPERTY; AND INSTRUCTING THE CITY CLERK TO ATTEST THE SAID DEED AND PLACE THEREON THE OFFICIAL SEAL OF THE CITY OF BAYTOWN. WHEREAS , by a deed executed in 1956 , the City of Baytown granted, sold and conveyed unto S . V. Robberson, G. C. Lannou and B. B. Elliott, Trustees for Baytown Volun- teer Fire Department Station No. I , subject only to a re- versionary interest retained in said deed, the following des- cribed tract of land lying and being situated in the City of Baytown, Harris County, Texas , to-wit: OUT of the Southwest one-quarter of that certain 3 acre tract of land conveyed from F. T. Pelly to the City of Pelly, Texas (now the City of Baytown) , by Deed dated the 15th day of November, A. D. 1939 , and recorded in Vol. 1148, at Page 122 , Deed Records of Harris County, Texas , said tract herein conveyed being more particu- larly described by metes and bounds as follows : BEGINNING at a point Northerly and 6 feet perpendicular from the Northerly curb line of existing pavement on Nazro Street pro- jection, said point also being S . 66 Deg. .05 Min. W. , 203 . 42 feet from the SW corner of Block No. 22 , of Middletown Addition to the City of Pelly (now the City of Baytown) , Harris County, Texas ; THENCE, S . 59 Deg. 35 Min. W. , 119 . 25 feet, for corner; THENCE, N. 00 Deg. 25 Min. E. , in a line parallel to and at all points 16 feet Easterly from the curb of the paving on the East side of Lee Drive, 138. 17 feet, for corner; THENCE, N. 87 Deg. 24 Min. E . , 98.25 feet, for corner; THENCE, S . 02 Deg. 46 Min. E . , 82 . 17 feet, more or less , to the POINT OF BEGINNING, and containing 0 . 2547 acres of land, more or less . and WHEREAS , the said Baytown Volunteer Fire Department Station No. I erected upon the land so conveyed certain im- provements , used as a training building and recreation center under the supervision of the said Baytown Volunteer Fire De- partment Station No. I ; and WHEREAS , the said Baytown Volunteer Fire Department Station No. I has continually, from the date of said conveyance , utilized the premises and the improvements constructed thereon for the use and benefit of said department in its official training and for the recreation of its members ; and WHEREAS , the said Baytown Volunteer Fire Department Station No. I is no longer to be utilized by the City of Baytown in its present status , and as a department, is to be dissolved with its members being transferred to other depart- ments ; and WHEREAS , the City of Baytown desires to release its reversionary interest in and to the property so conveyed, and to transfer and convey the same to the said Baytown Volunteer Fire Department Station No. I for an adequate consideration; NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN : Section 1: That the Mayor of the City of Baytown be, and he is hereby, duly authorized and empowered to execute for and in the name of the City of Baytown a deed conveying the above described tract of land to S . V. Robberson, G. C. Lannou and B. B. Elliott, Trustees for Baytown Volunteer Fire Department Station No. I , for the purpose of divesting the City of its reversionary interest in the property previously conveyed to the said Grantees. -2- Section 2 : That the City Attorney is hereby duly authorized to prepare an appropriate deed for the conveyance of the said tract of land. Section 3 : That the City Clerk is hereby duly authorized to attest the deed when executed, and to affix thereto the official corporate seal of the City of Baytown, Texas . INTRODUCED, READ and PASSED by the City Council of the City of Baytown on this the 12th day of December, 1968 .
