BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, GIVING
THE CONDITIONAL CONSENT OF SAID CITY TO THE CREATION OF A
WATER CONTROL AND IMPROVEMENT DISTRICT; AND DECLARING AN
EMERGENCY.
Whereas, the City Council of the City of
Baytown, Texas , has been requested to give the consent of
said City to the initiation of proceedings leading to the
creation of a water control and improvement district to be
called Harris County Water Control and Improvement District
No. 117, said district to be for and within the area described
in the exhibit attached hereto, marked "Exhibit 1" , and made
a part hereof.
Whereas , the City of Baytown contains a popu-
lation of less than 50 ,000 inhabitants; and the political
subdivision, said water control and improvement district above
mentioned, will lie within two miles of the city limits of the
City of Baytown.
Whereas, the City Council of the City of Baytown
desires to give the City's conditional consent to the creation
of such district.
Whereas, the City Council of the City of Baytown
considers the adoption of this resolution as an emergency mea-
sure necessary for the immediate preservation of the public
business , property, health and safety of said City. Now, therefore;
Be it resolved by the City Council of the City
of Baytown:
Section 1: The City of Baytown hereby consents
and agrees to the initiation of proceedings to create a water
control and improvement district for and within the area des-
cribed in Exhibit 1, provided however, that the City of Baytown
have submitted to it for its inspection and approval detailed
engineering plans and profiles showing size and location of
all water and sewer facilities . The City of Baytown further
reserves the right to inspect the installation of such improve-
ments to determine that same comply with the plans as approved.
Section 2: This resolution and written consent
is given in conformity with Paragraph B, Section 8, Chapter
160 , Acts of the 58th Legislature, Regular Session, 1963, same
being designated as the Municipal Annexation Act.
Section 3: Because of the emergency recited in
the preamble hereof, this resolution shall take effect immediately
upon its adoption.
Introduced, read and passed by a majority of the
City Council of the City of Baytown on this the 23rd day of
May, 1968.
