CC Resolution No. 77 NO. 77 R E S O L U T I O N A RESOLUTION CANVASSING THE RETURNS OF THE SPECIAL MUNICIPAL ELECTION HELD WITHIN THE CITY OF BAYTOWN ON THE 1ST DAY OF bM, 1965, FOR THE PURPOSE OF ELECT- ING TWO COUNCILMEN FROM THE RESPECTIVE DISTRICTS NOS. 3 AND 6; DECLARING THE RESULTS OF SAID ELECTION; FIND- ING THAT NOTICE OF SAID ELECTION WAS DULY AND PROPERLY GIVEN AND THAT SAID ELECTION WAS DULY AND PROPERLY HELD AND THE RETURNS THEREOF MADE BY THE PROPER OFFICIALS IN ACCORDANCE WITH THE LAWS OF THE STATE OF TEXAS. ti4HEREAS, pursuant to Section 96, Article IX of the Charter of the City of Baytown, the City Council of said City, at a special meet- ing held on this the 12th day of iday, 1965, proceeded, as required by law, to canvas the returns of the Special P:lunicipal Election held in the City of Baytown on the lst day of P:iay, 1965, for the purpose of electing two Councilmen from the respective Districts Nos. 3 and 6, said Election having been held under and pursuant to the provisions of the Charter of said City and an Ordinance passed on the 14th day of April , 1965, calling said Election; and WHEREAS, said Election having been duly and regularly had and held as called in said Ordinance and according to law and the returns thereof having been duly made and the Election Judges having certified the results of said Election as hereinafter set out and the City Coun- cil having duly and regularly canvassed the returns of said Election and finding that the total votes cast at said Election were as follows, to0wit: For Councilman From District No. 3 Kenneth E. Badgett 1 ,430 Votes Don Mi. (Donnie) Hullum 2,197 Votes For Councilman From District No. 6 Raymond T. Donnelly 2,064 Votes I,i. E. ( Earl) Lively 1 ,569 Votes and 'adHEREAS, the City Council of the ;ity of Baytown finds the Election Returns as set out above to be accurate and correct and no election Protest or Contest having been filed with said Council or instituted in connection with said election; i,IO"i, THEREFORc, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTO�jN: Section 1 : That Don Nk. (Donnie) Hullum received a majority of the votes cast at said Election for the office of Councilman from District No . 3 and, accordingly, the said Don 161. (Donnie) Hullum is hereby declared elected to the office of Councilman from District No. 3 of the City of Baytown. Section 2: That Raymond T. Donnelly received a majority of the votes cast at said Election for the office of Councilman from District No . 6 and, accordingly, the said Raymond T. Donnelly is hereby declared elected to the office of Councilman from District No . 6 of the City of Baytown. Section 3: That the City Council of the City of Baytown fur- ther finds that the Notice of said Election was duly and properly given as required by law and as provided in the Ordinance calling said Election and that said Election was duly and regularly held and the returns thereof duly and regularly made by the proper officials of said Election and in all things according to law.
