CC Resolution No. 73 41 NB 7 3 RESOL UTION A RESOLUTION CANVASSING THE RETURNS OF THE REGULAR MUNICIPAL ELECTION HELD WITHIN THE CITY OF BAYTOWN ON THE 6TH DAY OF APRIL, 1965, FOR THE PURPOSE OF ELECTING A MAYOR FROM THE CITY AT Lj;RGE; j'.ND THREE COUNCILMEN FRO1.1 THE RESPECTIVE DISTRICTS NOS. 2, 3 ,'JqD 6, DECL,►RING THE RESULTS OF S;.ID ELECTION, FIND- ING TH,,T NOTICE OF SAID ELECTION W,iS DULY .',ND PROPER- LY HELD .',ND THE RETURNS THEREOF t4►DE BY THE PROPER OFFICI,*J.S IN ,'tCCORD,►NCE WITH THE L* MS OF THE ST,.TE OF TEX,'►S. WHERE,',S, pursuant to article IX, Section 96, of the Charter of the City of Baytown, the City Council of said City, at a special meeting held on this 14th day of April, 1965, proceeded, as required by law, to canvas the returns of the Regular Municipal Election held in the City of Baytown on the 6th day of ►pril, 1965, for the purpose of electing a Mayor from the City at large and three (3) Councilmen from the respective Districts Nos. 2, 3 and 6, said Election having been held under and pursuant to the provisions of the Charter of said City and an Ordinance duly passed on the 28th day of January, 1965, calling said Election; and WHERE,*S, said Election having been duly and regularly had and held as called in said Ordinance and according to law and the re- turns thereof having been duly made and the Election Judges having certified the results of said Election, as hereinafter set out, and the City Council having duly and regularly canvassed the returns of said Election and finding that the total votes cast at said Election were as follows, to-wit: For Mavor From The City ►t Large Seaborn Craven 2,601 Votes Lamar Kelley 2,179 Votes For Councilman From District No. 2 David_C. Clark 2,986 Votes For Councilman From District No. 3 James E. (Jim) Walker 540 Votes Vesone Devereaux, Sr. 281 Votes Don M. (Donnie) Hullum 1 ,806 Votes For Councilman From District No. 6 M. E. (Earl) Lively 1 ,723 Votes Raymond T. Donnelly 2,147 Votes Charles E. Gates 902 Votes AND WHEREAS, the City Council of the City of Baytown finds the Election Returns as set out above to be accurate and correct and no Election Protest or Contest having been filed with said Council or instituted in connection with said Election, NOW, THERE- FORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: Section 1: That Seaborn Cravey received a majority of the votes cast at said Election for the office of Mayor from the City at Large and, accordingly, the said Seaborn Cravey is hereby elected to the office of Mayor of the City of Baytown. Section 2: That David C. Clark received a majority of the votes cast at said Election for the office of Councilman from District No. 2 and, accordingly, the said David C. Clark is hereby elected to the office of Councilman from District No. 2 of the City of Baytown. Section 3: That as shown above no candidate received a maj- ority of the votes cast at said Election for the office of Council- man from District No. 3 and, accordingly, it is necessary that a Run-Off Election be held to elect a Councilman from said District No. 3 - and it appearing that Kenneth E. Badgett - and Don M. (Donnie) Hullum are the two candidates receiving the highest number of votes cast at said Election for the office of Councilman from District No. 3, it is, therefore, ORDERED that a Special Run-Off Election be held for the purpose of electing one of these candidates for said office. Section 4: That as shown above no candidate received a maj- ority of the votes cast at said Election for the office of Council- man from District No. 6 and, accordingly, it is necessary that a Run-Off Election be held to elect a Councilman from said District No. 6 - and it appearing that r M. E. (Earl) Lively - and Raymond T. Donnelly are the two candidates receiving the highest number of votes cast at said Election for the office of Councilman from District No. 6, it is, therefore, ORDERED that a Special Run-Off Election be held for the purpose of electing one of these candidates for said office. Section 5: That the City Council of the City of Baytown further finds that the Notice of said Election was duly and properly given as required by law and as provided in the Ordinance calling said Election and that said Election was duly and regularly held and the returns thereof duly and regularly made by the proper of- ficials of said Election, and in all things according to law. INTRODUCED, READ and PASSED by the affirmative vote of the members of the City Council of the City of Baytown on this the 14th day of April, 1965.
