[JHERE„S, the City Council of the City of Baytown is the only
local legislative body with power to regulate the rates and services
of a public utility; and
;JHERE,,S, the City Council is anxious to attain and maintain a
high level of service by all public utilities and to establish and
maintain proper rates for such services ; and
JHERE,,S, the City Council has recently been exploring the possi-
bilities of increasing the efficiency and operations of the local tele-
phone utility company and has made a comparison and study of telephone
rates in Baytown and other Texas cities ; and
IJHERE.,S, the City Council is of the opinion that the services of
such utility can be increased and the rates for such services can be
adjusted and still provide a fair rate of return to such utility; and
ti1HERE,,S, there are certain legal dictates which must be followed
to assure the successful conclusion of these goals; NO11, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF B.,YTOiJN:
Section 1: That the General Telephone Company of the Southwest
is hereby officially placed on notice that the City Council of the City
of Baytown directs and hereby calls a hearing for the 24th day of tray,
1965, and that such hearing is to afford said utility an opportunity to
show cause why its services should not be increased and its rates for
such services be decreased. That should this date not afford said util-
ity sufficient time to prepare for such hearing , that it should so noti-
fy the Mayor and City Manager of this City as soon as "possible so that
another date may be agreed upon.
Section 2: That the City manager of the "ity of Baytown is
hereby directed by and through his department heads and officers to
make any and all preparations for such hearing to the end that the
public interest will best be served, including, if necessary, the
employment of a private rate consultant.
Section 3: That the City 6,anager is hereby directed to see to
it that copies of this resolution are properly executed and certified,
and that he shall furnish one of such copies to the local manager of
the General Telephone Company of the Southwest, I:.r. E. 0. Cambern, by
registered mail ; and one copy by the same method to the President, i ;r.
