CC Resolution No. 59 RESOLUTION 59 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN GIVING THE GENERAL TELEPHONE COMPANY OF THE SOUTHWEST OFFICIAL NOTICE, PURSUANT TO ARTICLE XI, SECTION 125, OF THE CHARTER OF SUCH CITY, OF A HEARING TO BE HELD BY AND BETWEEN SAID COUNCIL AND UTILITY FOR THE PURPOSE OF UPGRADING THE SERVICES OF SUCH UTILITY; DIRECTING THE ADMINISTRA- TIVE STAFF OF THE CITY TO MAKE PROPER PREPARATIONS FOR SUCH HEARING AND DIRECTING THE CITY MANAGER TO IMMEDIATELY FURNISH AN EXECUTED COPY OF THIS RESOLUTION TO THE UTILITY'S LOCAL MANAGER AND THE COMPANYIS PRESIDENT IN SAN ANGELO, TEXAS WHEREAS, the City Council of the City of Baytown is the only local legislative body with power to regulate the rates and service of a public utility; and WHEREAS, the City Council is anxious to attain and maintain a high level of service by all public utilities; and WHEREAS, the City Council has recently been exploring the possibilities of acquiring for the telephone subscribers of the City of Baytown extended area service to Houston and generally increase the efficiency and operations of the local telephone utility company; and WHEREAS, there are certain legal dictates which must be followed to assure the successful conclusion of these calls; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: Section 1 . That the General Telephone Company of the Southwest is hereby officially placed on notice that the City Council of the City of Baytown directs that there be a hearing as soon as possible with the General Telephone Company of the Southwest . The City Council requests that such utility company notify the Council as soon as possible of a time for such hearing convenient to it, but if the utility company does not set a hearing date before January 14, 1965, the Council hereby orders a hearing for such date at 6: 30 p .m. , in the Council Chambers at City Hall in Baytown, Texas . Section 2. That such hearing is called pursuant to Article XI, Section 125, of the Charter of the City of Baytown, and is for the purpose of acquiring extended area service so that the subscribers of this City may dial the Houston exchange without paying a toll charge for such privilege. Furthermore, such hearing will be for the further purpose of seeing whether or not the services of such utility company may be improved . Section 3. That the City Manager of the City of Baytown is hereby directed by and through his department heads and officers to make any and all preparation for such hearing to the end that the public interest will best be served . Section 4. That the City Manager is hereby directed to see to it that copies of this resolution are properly executed and certified, and that he shall furnish one of such copies to the local manager of the General Telephone Company of the Southwest, Mr. E. 0. Cambern, by registered mail; and one copy by the same method to the President, Mr. E. H. Danner, San Angelo, Texas .
