CC Resolution No. 14 R E S U L U T I 0 N No, 14-2-63 A RESOLUTION Or THE CITY COUNCIL OF THE CITY OF BAYT(XIN DEFINING AND CLASSIFYING STREETS AND THOROUGH- FARES ACCORDING TO THEIR USE AND LOCATION; SETTING FORTH THE METHOD .AND THE TYPES OF MATERIALS TO BE USED IN IMPROVING SUCH STREETS; DECLARING THAT SUCH STREETS, WHEN IMPROVED, SHALL BE IMPROVED ON A PARTICIPATION BASIS BETWEEN THE CITY AND THE ABUTTING PROPERTY OWNERS; PROVIDING FOR CERTAIN PROCEDURES AND STAPTDARDS OF OPERATION; AUTHORIZING .AND DIRECTING THE CITY MANGER TO TAKE hNY AND ALL STEPS NECESSARY TO EFFECTUATE THIS RESOLUTION AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. WHERr�:1S, the City Council believes it should define and classify Baytownts streets and thoroughfares according to use and location; and WHEREAS, Council believes that written standards of construction for major improvements should be adopted so as to provide for the equitable and orderly im- provement of such streets and thoroughfares; and WHEREAS, Council believes that the abutting property owners benefit materially from the major improvement of such sti,•eets and that the City can renovate more streets under a participation program; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL Or THE CITY OF B:►YTOIdN: Section 1 : That henceforth, streets and thoroughfares in Baytown shall be classified and defined as follows, to-wit: I. Class A - Residential Streets: Such streets shall be those primarily used by local residents; vehicular traffic will be relatively light and will consist mainly of passenger automobiles with an occasional heavy truck. Example: East Hunnicutt Street. II. Class B -- Residential Thoroughfares: Such streets shall be through residential areas with moderate to occasional heavy traffic, used by local residents as well as others. Vehicular traffic will consist mainly of passenger automobiles but there will be more heavy truck traffic than on Class A streets. Example: West Lobit Street. III. Class C -- Commercial Streets: Such streets shall have a large volume of traffic--automobiles and heavy trucks - and shall be through business areas. ISSample: North Main Street. Section 2: That the above defined streets and thoroughfares, when subjected to major improvements shall be improved according to the following standards, or their 2quivalent: Class A - Residential Streets: Such streets should be properly drained, have a flexible base constructed " of thoroughly compacted flexible base consisting of asphalt stabilized shell, sand stabilized shell, compacted limestone or equivalent material, six inches thick with two courses of inverted penetration wearing surface. r 1 1 r.. 07.ass B - gesidential Thoroughfares: Such thoroughfares should be properly drained, have a semi-rigid base (7" of cement stabilized shell or its equivalent) with two or three courses of inverted penetration wearing surface or one and one-half inches of asphaltic con- crete. Class C - Commercial Streets: Such streets should be properly drained, constructed of seven inch reinforced concrete, or ten inches of cement stabilized shell with two inches of asphaltic concrete, or equivalent construction. Section 3: That property owners may petition the Council for major improvements to residential thoroughfares and commercial streets on a participation basis in the same manner that they are authorized to ask that residential streets be improved; provided, that such petitions shall be advisory only and the Council may ignore same or act in the absence of petitions. Major permanent improvements are defined as projects wherein the cost of the Job exceeds 50% of the cost of the original street construction based on the City Engineers estimate using current cost prices. The City Council will also decide when major permanent improvements are needed and will require property owners to participate in these improvement costs as described herein. Section 4: That residential streets which are given major permanent improve- ments by the Class A standards will be done on a participation basis only to the extent of the cost of curb and gutter. This limitation will be waived if property owners petition the Council for such improvements under this resolution or under another Residential Street Improvement Resolution, dated 2/14/63. Property owners will be given credit for curbs and gutter as follows: That the abutting property owners shall receive a credit (which shall be deducted from their cost) for any curbs and gutters which were previously con- structed according to the City's plans and specifications and under the City's supervision; provided, that such curbs and gutters are still usable or are not de- fective through any fault of the abutting property owner. The consideration that such abutting property owner shall receive as a credit shall depend on a cost estimate prepared by the City Engineer and approved by the City Council. Section 5: That major improvements to residential thoroughfares shall be done through the participation of the City and the abutting property owners. The proper- ty owners' share of the project shall be arrived at by the following formula: (a) Divide the total estimated cost of curb and gutter by number of feet to be installed to arrive at a per foot cost of curb and gutter. (b) Divide the total cost of other improvements by the number of feet of street to be improved to arrive at a per foot cost of this portion of the porject. (c) The property owners' share of the curb and gutter shall be the estimated "* per foot cost multiplied by the number of feet of property he owns adjacent to the street to be so improved. (d) The property owners' share of the other improvements shall be per cent of the total per foot cost of such improvements limited to 31 ' width, multiplied by the number of feet of property he owns adjacent to the street to be improved. The Council may, at its discretion, reduce the property owners' share of the cost of such improvements if the owners' street runs along the side of the owner's property as opposed to the front of his property. (e) Abutting property owners sh=ail not be required to pay any portion of the costs of storm sewers. (f) That the abutting property owners shall receive a credit (which shall be deducted from their cost) for any curbs and gutters which were previously con- structed according to the City's plans and specifications and under the City's supervision; provided, that such curbs and gutters are still usable and are not de- fective through any fault of the abutting property owner. The consideration that such abutting property owner shall receive as a credit shall be based on a re- placement cost estimate prepared by the City Engineer using current cost prices, and approved by the City Council. Section b: That major improvements to commercial streets shall be done through the participation of the Cite and the abutting property owners. The property owners' share of the projeci, shall be arrived at by the following formula: (a) Divide the total estimated cost of curb and gutter by number of feet to be installed to arrive at a per foot cost of curb and gutter. (b) Divide the total cost of other improvements by the number of feet of street to be improved to arrive at a per foot cost of this portion of the project.
