CLASSIFYING STREETS AND THOROUGHFARES ACCORDING TO THEIR
USE AND LOCATION; SETTING FORTH THE METHOD AND THE TYPES
OF MATERIALS TO BE USED IN IMPROVING SUCH STREETS; DE-
CLARING TH1T SUCH STREETS, 1THEN IMPROVED, SHAD L BE IMPROVED
ON A P.'.RTICIPATION BASIS BETWEEN THE CITY AND THE !BUTTING
PROPERTY OWNERS; TH-T THE CITY SHALL UNDERTAKE TO IMPROVE
STREETS IN THE ORDER THAT IT RECEIVES PROPERLY EXECUTED
PETITIONS FROM ABUTTING PROPERTY OWNERS; THAT THE CITY CLERK
SHALL KEEP PETITION FORMS AVAILABLE FOR INTERESTED PARTIES;
THAT THE CITY ENGINEER SHALL, WITHIN 30 D!>YS AFTER A
PETITION IS OBTAINED FROM THE CITY CLERK BY AN ABUTTING
PROPERTY OWNER, PREPARE COST ESTIMATES LAID ANY OTHER
ENGINEERING DATA HE I41Y DEEM PERTINENT TO THE END THAT THE
AFFECTED PROPERTY OWNERS WILL BE APPRAISED OF THEIR PRO
RATA SHARE OF THE COST OF SUCH IMPROVEMENTS; AUTHORIZING
AND DIRECTING THE CITY MANAGER TO TAKE ANY AND ALL STEPS
NECESSARY TO EFFECTUE.TE THIS RESOLUTION AND PROVIDING FOR
THE EFFECTIVE DATE TtiFREOF.
WHEREAS, the City Council of the City of Baytown believes it should permanently
improve a number of residential streets; and also believes that owners who are
interested in improving their streets and who are willing to share in the improve-
ment cost thereof voluntarily should have means available to them for getting such
improvements done in an orderly, recognized fashion by the City and that they
should receive priority treatment; and,
WHEREAS, Council believes that the abutting property owners benefit from the
improvements of such streets and the City can renovate more streets under such a
program; and
WHEREAS, certain policies and procedures should be adopted so as to enhance the
orderly implementation of such a program; NUJI THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN:
Section 1 : That henceforth, street, and thoroughfares in Baytown shall be
classified and defined as follows, tcTit:
I. Class A -- Residential Streets:
Such streets shall be those primarily used by local
residents; vehicular traffic will be relatively light and
will consist mainly of passenger automobiles with an oc-
casional heavy truck. Exaunle: East Hunnicutt Street.
II. Class B -- Residential Thoroughfares:
Such streets shall be through residential areas with
moderate to occasional heavy traffic, used by local residents
as well as others. Vehicular traffic will consist mainly of
passenger automobiles but there will be more heavy truck
traffic than on Class A streets. Exam le: West Lobit Street.
III. Class C -- Commercial Streets:
Such streets shall have a large volume of traffic--
automobiles and heavy trucks - and shall be through business
areas. Example: North Fain Street.
Section 2: That the above defined streets and thoroughfares, when subjected
to major improvements, shall be improved according to the following standards, or
their equivalent:
(1 ) Clnns AA- Residential Streets: Such streets should be properly
drained, have a thoroughly compacted flexible base consisting
of asphalt stabilized shell, sand stabilized shell, compacted
limestone or equivalent material, six inches thick with two
courses of inverted penetration wearing surface.
(2) Class IL- Residential Thoroughfares: Such thoroughfares should
be properly drained, have a semi-rigid base (7" of cement stabil-
ized shell or its equivalent) with two or three courses of in-
verted penetration wearing surface or one and one-half inches
of asphaltic concrete.
(3) Class C - Commercial Streets: Such streets should be properly
drained, constructed of seven inch reinforced concrete or ten
inches of cement stabilized shell with two inches of asphaltic
concrete, or equivalent construction.
Section 3: That the City Council of the City of Baytown hereby transfers
Seventy-Five Thousand W75,000.00) Dollars from the Street Capital Expenditures
Budget Appropriations Account No. 301-9-6 to the Residential Street Account W.
301-9-10 for the fiscal year ending September 30, 1963. BE IT FURTHER RESOLVED
that such sum of money shall not be used for maintenance but shall only be expended
for major permanent improvement of residential streets on a participation basis as
heretofore provided for by the laws of the State of Texas and acts of the City
Council of the City of Baytown. To this end, the City Clerk is hereby directed
to keep petition forms in her office for the use of interested property owners.
Major permanent improvements are defined as projects wherein the cost of the job
exceeds 50% of the original street construction costs as estimated by the City
Engineer using current construction pricas. Minimum construction standards which
will be used are those which apply to residential streets, known as Class A. The
property owners may request Class B or C type streets and the City will honor such
requests. The City Engineer may specify that a Class B or C is needed and this
will govern the construction standards and costs to be used and the petition will
so reflect.
Section 4: That the City Clerk shall notify the City Engineer when a petition
with the signatures of a minimum of three property owners on a given street has
been returned to her office and in the order returned. Immediately after the
receipt of such notice, but in no event more than 30 days, the City Engineer shall
prepare cost estimates and any other engineering data he may deem pertinent so
that property owners can be apprised of their pro rate share of the cost of such
improvements. This estimate shall be prepared separately as to the cost of curb
and gutter and cost of other improvements. The property owners' share of the
project shall be arrived at by the following formula:
A. Divide the total estimated cost of curb and gutter by number of feet to
be installed to arrive at a per foot cost of curb and gutter.
B. Divide the total cost of other improvements by the number of feet of
street to be improved to arrive at a per foot cost of this portion of
the project.
C. The property owners' share of the curb and gutter shall be the estimated
per foot cost multiplied by the number of feet of property he owns ad-
jacent to the street to be so improved. If the owner has usable curb
and gutter, this portion of the cost shall not apply.
D. The property ownerst share of the other improvements shall be
the total per foot cost of such improvements multiplied by the number
of feet of property he owns adjacent to the street to be improved. The
Council may, at its discretion, reduce the property owners' share of
the cost of such improvements if the street runs along the side of the
owners' property as opposed to the front of his property.
E. Abutting property owners shall not be required to pay any portion of the
costs of storm sewers.
After approval of the City Engineer and City 1,mnager, the information shall be
entered in the petition prior to its =ssuance by the City Clerk.
Section 5: The City shall improve residential streets in the order that it
receives properly executed petitions from abutting property owners. No street
shall be so improved until 70% of such abutting property owners sign such petition.
Section 6: That the City Manager is hereby authorized and directed to make,
or cause to be made, detailed studies and recommendations in order that the dictates
of this resolution shall be effectuated.
