Declaration of Local Disaster
WHEREAS, Tropical Storm Beta poses a threat of imminent disaster, including severe flooding,
storm surge and damaging winds in the City of Baytown, in the Counties of Harris and Chambers, Texas;
and
WHEREAS, the imminent threat of this storm requires the City to take immediate action to save
lives, to prevent injuries, to protect property, public health, the environment and public safety, and to
lessen or avert the threat of disaster; and
WHEREAS, the Mayor of Baytown has determined that extraordinary measures must be taken to
alleviate the suffering of people and to protect or rehabilitate property;
NOW, THEREFORE, BE IT PROCLAIMED AND ORDERED BY THE MAYOR OF THE
CITY OF BAYTOWN, TEXAS:
Section l: That a local state of disaster is hereby declared for the City of Baytown due to
Tropical Storm Beta pursuant to Section 418.108(a) of the Texas Government Code.
Section 2: That pursuant to Section 418.108(d) of the Texas Government Code, this
declaration of a local state of disaster (i) activates the recovery and rehabilitation aspects of not only the
emergency operations plan of the City but also all applicable interjurisdictional emergency management
plans and (ii) authorizes the furnishing of aid and assistance under the declaration.
Section 3: That pursuant to Section 418.108(f) of the Texas Government Code, the Mayor
reserves the right to order the evacuation of all or part of the population from a stricken or threatened area
in the City if the Mayor considers the action necessary for the preservation of life or other disaster
mitigation, response, or recovery.
Section 4: That pursuant to Section 418.108(g) of the Texas Government Code, the Mayor
reserves the right to control ingress to and egress from a disaster area within the City and to control the
movement of persons and the occupancy of premises in that area.
Section 5: That failure to obey any order issued under this disaster declaration may result in
criminal penalties as provided by law.
Section 6: That pursuant to Section 418.108(b) of the Texas Government Code the state of
disaster declared in Section 1 hereof shall continue for a period of not more than seven days from the date
of this declaration unless continued or renewed by the City Council of the City of Baytown.
Section 7: This declaration of a local state of disaster shall be given prompt and general
publicity and shall be filed promptly with the City Clerk pursuant to Section 418.108(c) of the Texas
Government Code.
Section 8: That this proclamation shall take effect immediately from and after its issuance.
