BAWA Resolution No. 2020-10RESOLUTION NO. 2020-10 A RESOLUTION OF THE BOARD OF DIRECTORS OF THE BAYTOWN AREA WATER AUTHORITY AWARDING THE SOUTH LAGOON SLUDGE REMOVAL PROJECT TO SYNAGRO OF TEXAS -CDR, INC., SUBJECT TO THE APPROVAL OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS; AUTHORIZING PAYMENT IN THE AMOUNT OF ONE HUNDRED THIRTY-SEVEN THOUSAND FIVE HUNDRED AND 00/100 DOLLARS ($137,500.00) TO SYNAGRO OF TEXAS - CDR, INC.; MAKING OTHER PROVISIONS RELATED THERETO; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. WHEREAS, the Baytown Area Water Authority advertised for bids for the South Lagoon Sludge Removal Project (the "Project") to be received on June 15, 2020; and WHEREAS, notice to bidders as to the time and place, when and where the bids would be publicly opened and read aloud was published; and WHEREAS, all bids were opened and publicly read at City Hall at 9:00 a.m., Monday, June 15, 2020, as per published notice to bidders; and WHEREAS, after considering the recommendation of BAWA's engineer, the Board believes that awarding the bid to Synagro of Texas -CDR, Inc., the lowest responsible bidder, will be most advantageous to BAWA and will result in the best and most economical completion of the Project; NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE BAYTOWN AREA WATER AUTHORITY: Section 1: That subject to the approval of the City Council of the City of Baytown, the Board of Directors of the Baytown Area Water Authority hereby accepts the bid of Synagro of Texas -CDR, Inc., for the South Lagoon Sludge Removal Project according to the plans and specifications set forth by BAWA's Engineer in an amount of ONE HUNDRED THIRTY-SEVEN THOUSAND FIVE HUNDRED AND 00/100 DOLLARS ($137,500.00) to Synagro of Texas -CDR, Inc.; and the General Manager and the Assistant Secretary of the Baytown Area Water Authority are hereby authorized and directed to execute and attest to a contract with Synagro of Texas -CDR, Inc., for the above -described project, said contract containing the plans, specifications, and requirements of BAWA's engineer and appropriate bond requirements in accordance with the provisions of Texas Government Code, Chapter 2253. Section 2: That the General Manager is hereby granted general authority to approve any change order involving a decrease or an increase in costs of FIFTY THOUSAND AND NO/100 DOLLARS ($50,000.00) or less; however, the aggregate of the change orders may not increase the original contract price by more than twenty-five percent (25%). Section 3: This resolution shall take effect immediately from and after its passage by the Board of Directors of the Baytown Area Water Authority.
