Ordinance No. 14,445ORDINANCE NO. 14,445 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, AUTHORIZING THE PAYMENT OF ONE HUNDRED TWENTY THOUSAND FOUR HUNDRED THIRTY-THREE AND 40:' 100 DOLLARS ($120,433.40) TO AXON ENTERPRISE INC. F/K/A TASER INTERNATIONAL, INC., FOR THE FOURTH -YEAR OF A FIVE-YEAR PLAN FOR THE POLICE DEPARTMENT'S BODY -WORN CAMERA REPLACEMENT PROGRAM, THROUGH THE TEXAS LOCAL GOVERNMENT PURCHASING COOPERATIVE (BUY BOARD); MAKING OTHER PROVISIONS RELATED THERETO; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. ********************************************************************************* WHEREAS, the City of Baytown is a member of the cooperative purchasing program established under Sections 271.082 and 271.083 of the Texas Local Government Code; and WHEREAS, the Texas Local Government Purchasing Cooperative's Buy Board Program is such a program, allowing municipalities to purchase products and/or services in an efficient, cost effective, and competitive procurement method; and WHEREAS, the City of Baytown, in making a purchase under a state contract through such cooperative purchasing program, satisfies state law requiring municipalities to seek competitive bids for the purchase of the item; WHEREAS, on April 13, 2017, City Council approved Ordinance No. 13,449, which authorized the purchase of one hundred ten (110) body -worn cameras, its related equipment and an all-inclusive unlimited data storage plan for the Police Department, from Axon Enterprise Inc., f/k/a Taser International, Inc., through the Texas Local Government Purchasing Cooperative (Buy Board); and WHEREAS, the fourth of five payments for the replacement program is now due; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown hereby authorizes the payment of ONE HUNDRED TWENTY THOUSAND FOUR HUNDRED THIRTY-THREE AND 40100 DOLLARS ($120,433.40) to Axon Enterprise Inc. f/k/a Taser International, Inc., for the fourth -year of a five-year plan for the Police Department's Body -Worn Camera Replacement Program. Section 2: That the City Manager is hereby granted general authority to approve any change order involving a decrease or an increase in costs of FIFTY THOUSAND AND N& 100 DOLLARS ($50,000.00) or less, provided that the original contract price may not be increased by more than twenty-five percent (25%) or decreased by more than twenty-five percent (25%) without the consent of the contractor to such decrease. Section 3 : This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown.
