A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS, AMENDING SECTION 2 OF RESOLUTION NO. 2244, PASSED ON
THE 23RD OF MAY, 2013, CONCERNING THE CITY'S MATCH FOR THE
MAKE IT IN AMERICA CHALLENGE GRANT TO AUTHORIZE A CASH
MATCH NOT TO EXEEED FIVE HUNDRED THOUSAND AND NO/100
DOLLARS ($500,000.00) PER YEAR FOR FIVE (5) YEARS, SUBJECT TO
NON-FUNDING FOR FUTURE YEARS; AND PROVIDING FOR THE
EFFECTIVE DATE THEREOF.

WHEREAS, on May 23, 2013, the City Council through Resolution No. 2244 authorized
the City Manager to participate in the submission of an application to the U.S. Department of
Commerce's Economic Development Administration for the Make it in America Challenge
Grant on behalf of the Baytown Fire Department in the amount of TWO MILLION AND
NO/100 DOLLARS ($2,000,000.00); and
WHEREAS, Resolution No. 2244 authorized an in-kind match, which the City proposed
to fulfill through land and industrial equipment expected to be donated by the City's local
industrial partners; and
WHEREAS, the grant now requires the City to provide a cash match in an amount of
FIVE HUNDRED THOUSAND AND NO/100 DOLLARS ($500,000.00) per year for five
years; and
WHEREAS, the City Council desires to amend Resolution No. 2244 to authorize the cash
match, subject to a non-funding provision for future years; NOW THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: That Section 2 of Resolution No. 2244, passed on May 23, 2013, is hereby
amended to read as follows:
Section 2: That pursuant to the terms of the Make it in America
Challenge Grant, the City Council of the City of Baytown hereby authorizes a
cash match in an amount of FIVE HUNDRED THOUSAND AND NO/100
DOLLARS ($500,000.00) per year for five (5) years. Such cash match for
subsequent years is expressly contingent upon sufficient appropriations and
authorization being made by the City and/or the Baytown Fire Control,
Prevention, and Emergency Medical Services District ("BFCPEMSD") each year.
If at any time sufficient appropriations are not made by the City Council or the
Board of Directors of the BFCPEMSD, the City will not be liable for funding
beyond the last year in which the funds were so appropriated.
Section 2: This resolution shall take effect immediately from and after its passage by
the City Council of the City of Baytown.
