A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS, ADOPTING THE COMMUNITY DEVELOPMENT BLOCK GRANT
(CDBG) SECTION 3 PLAN FOR THE CITY OF BAYTOWN; DESIGNATING
A SECTION 3 COORDINATOR AND A SECTION 3 COMPLIANCE
ADVISORY BOARD; AND PROVIDING FOR THE EFFECTIVE DATE
THEREOF.
WHEREAS, the United States Congress passed Section 3 of the Housing and Urban
Development Act of 1968 (12 U.S.C. 1701u) (Section 3) to further the goal of ensuring that
federal funds benefit the residents of projects funded wholly or in part by those funds; and
WHEREAS, Part 135 establishes employment and contracting opportunities for Section 3
businesses and Section 3 residents along with procedures for reporting on economic
opportunities; and
WHEREAS, the requirements of Section 3 apply to recipients of HUD funding in excess
of $200,000.00 and to individual contracts of $100,000.00 for housing rehabilitation, housing
construction, and public improvements; and
WHEREAS, the Texas General Land Office ( "GLO ") requires that all recipients of
Round 2.2 disaster recovery funding implement a Section 3 Plan; and
WHEREAS, the City has created a Section 3 Plan to comply with 24 CFR Part 135 as
prescribed in the Act, which requires the City to:
➢ notify Section 3 residents and businesses about training, employment and
contracting opportunities generated by Section 3 covered projects;
➢ notify contractors working on Section 3 covered projects of their responsibilities;
➢ incorporate a Section 3 clause into all covered solicitations and contracts;
➢ document actions taken to comply with Section 3; and
➢ submit Section 3 Annual Summary Reports to HUD; and
WHEREAS, the City's Section 3 Plan also designates the Community Development
Senior Program Manager as the Section 3 Coordinator and the Community Development
Advisory Committee ( "CDAC ") as the Section 3 Compliance Advisory Board; and
WHEREAS, on December 11, 2012, the Community Development Advisory Committee
( "CDAC ") affirmatively voted to recommend the proposed Section 3 Plan for adoption by City
Council; and
WHEREAS, based, in part, upon the recommendation of the CDAC, the City Council
desires to adopt the Plan; NOW THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: That the City Council of the City of Baytown, Texas, has reviewed the
City's Community Development Block Grant Section 3 Plan (the "Plan ") and hereby adopts the
Plan, which is attached hereto as Exhibit "A" and incorporated herein for all intents and
purposes.
Section 2: That the City Council of the City of Baytown, Texas, in accordance with
the Plan hereby designates the Community Development Senior Program Manager as the
Section 3 Coordinator and the Community Development Advisory Committee ( "CDAC ") as the
Section 3 Compliance Advisory Board.
Section 3: This resolution shall take effect immediately from and after its passage by
the City Council of the City of Baytown, Texas.

Section 3 Purpose
Section 3 is a provision of the U. S. Department of Housing and Urban Development (HUD) Act of 1968,
(12 U.S.C. 1701u). The purpose of Section 3 is to ensure the employment and other economic opportunities
generated by certain HUD financial assistance shall, to the greatest extent feasible, and consistent with
federal, state and local laws and regulations, be directed to low - and very low income persons.
Employment and economic opportunities generated by such projects should particularly benefit individuals
who are recipients of government assistance for housing, and be directed to business concerns which
provide economic opportunities to low - and very low income persons.
Each year, HUD invests billions of federal dollars into distressed communities for projects designed to
build and rehabilitate housing, improve roads, develop community centers, and otherwise assist families in
achieving the American dream. Section 3 regulation recognizes that HUD funding typically results in
projects /activities that generate new employment, training and contracting opportunities. These economic
opportunities not only provide "bricks and mortar ", but can also positively impact the lives of local
residents who live in the neighborhoods being redeveloped.
Section 3 is HUD's legislative directive for providing preference to low - and very low- income residents of
local communities (regardless of race or gender), and the businesses that substantially employ these
persons, for new employment, training, and contracting opportunities resulting from HUD- funded projects.
Further, as a condition of receiving HUD Community Planning and Development assistance, recipients
certify that they will comply with the requirements of Section 3 annually pursuant to 24 CFR 570.607(b).
Accordingly, HUD has the legal responsibility to monitor recipients for compliance and can impose
penalties upon those that fail to meet these obligations.
The State of Texas Analysis of Impediments to Fair Housing, January 2011, also encourages the use of
Section 3 to further fair housing choice. Specifically, it says "Using an effective program under Section 3
of the Housing and Urban Development Act of 1968 may help members of protected classes gain economic
opportunities necessary to allow them to exercise fair housing choice."
Applicability
Section 3 requirements apply to recipients of HUD Community Planning and Development assistance
exceeding $200,000. As an entitlement community, the City of Baytown receives Community
Development Block Grant funds directly from HUD annually.
Section 3 covered projects are those in which a combined (or aggregate) amount of covered funding
exceeding $200,000, is invested into activities involving:
• Housing Construction, Demolition, and Rehabilitation (including reduction and abatement of lead
base paint hazards);
• Public Infrastructure (including streets, sewers, waterlines);
• Public Facilities and Park Improvements and;
• Job Creating or Job Sustaining for Economic Development Projects.
Section 3 compliance is also applicable to employment associated with professional services such as
architectural, engineering, legal, management and administrative support. Note: Section 3 applies to the
entire covered project or activity regardless of whether the activity was fully or partially funded with
3
covered assistance. Contractors or subcontractors that receive contracts in excess of $100,000 for Section 3
covered projects /activities are also required to comply with Section 3 regulations in the same manner as
direct recipients of federal funds from HUD. However, if the City receives Section 3 covered funding and
invests these funds into covered projects /activities, but no individual contract exceeds $100,000, then the
responsibility for complying with Section 3 only applies to the City of Baytown.
Finally, whenever Section 3 is applicable, the City of Baytown must attempt to reach the Section 3
minimum numerical goals found in 24 CFR Part 135.30 by:
Awarding 10% of the total dollar amount of all covered construction contracts to Section 3 businesses;
Awarding 3% of non - construction contracts to Section 3 businesses and;
Offering 30% of new employment opportunities to Section 3 residents.
Section 3 is triggered when the normal completion of construction and rehabilitation projects creates the
need for new employment, contracting, or training opportunities. The Section 3 regulations should not be
construed to mean that the City is required to hire Section 3 residents or award contracts to Section 3
businesses other than what is needed to complete covered projects /activities. If the expenditure of covered
funding does not result in new employment, contracting, or training opportunities, the requirements of
Section 3 have not been triggered.
Section 3 Definitions
Employment Opportunities Generated by Section 3 Covered Assistance — All employment opportunities
generated by the expenditure of Section 3 covered projects (24CFR §135.3(a)(2), including management
and administrative jobs connected with the Section 3 covered project. Management and administrative jobs
include architectural, engineering or related professional services required to prepare plans, drawings,
specifications, or work write -ups; and jobs directly related to administrative support of these activities, e.g.,
construction manager, relocation specialist, payroll clerk, etc. (24 CFR § 135.5)
Housing and Community Development Assistance — Any financial assistance provided or otherwise made
available through a HUD housing or community development grant, loan, loan guarantee, cooperative
agreement, or contract. This includes community development funds in the form of community
development block grants and loans guaranteed under section 108 of the Housing and Community
Development Act of 1974, as amended. Housing and community development assistance does not include
financial assistance provided through a contract of insurance or guaranty. (24 CFR § 135.5)
Low - income Person — Families (including single persons) whose household incomes do not exceed 80
percent of the median income for the area (24 CFR §135.5). HUD's income limits may be obtained from:

New Hires — A full -time employee for a new permanent, temporary, or seasonal position that is created
during the expenditure of Section 3 covered financial assistance. (24 CFR § 135.5)
Section 3 Clause — The contract provisions set forth in 24 CFR §135.5 and listed in Exhibit A.
Section 3 Covered Assistance — Assistance provided under any HUD housing or community development
program that is expended for work arising in connection with: (i) Housing rehabilitation (including
reduction and abatement of lead -based paint hazards, but excluding routine maintenance, repair and

replacement); (ii) Housing construction; or (iii) Other public construction project (which includes other
buildings or improvements, regardless of ownership). (24 CFR §135.5)
Section 3 Covered Contract — A contract or subcontract (including a professional service contract)
awarded by a recipient or contractor for work generated by the expenditure of Section 3 covered assistance,
or for work arising in connection with a Section 3 covered project. (24 CFR § 135.5)
Section 3 Covered Project — The construction, reconstruction, conversion or rehabilitation of housing
(including reduction and abatement of lead -based paint hazards), other public construction which includes
buildings or improvements (regardless of ownership) assisted with housing or community development
assistance. (24 CFR §135.5)
Section 3 Resident — A person certified by the City who is a public housing resident and/or or a low- or
very low- income person residing in the metropolitan area or non - metropolitan county where the Section 3
covered assistance is expended. (24 CFR § 135.5)
Subcontractor — Any entity (other than a person who is an employee of the contractor) which has a
contract with a contractor to undertake a portion of the contractor's obligation for the performance of work
generated by the expenditure of Section 3 covered assistance, or arising in connection with a Section 3
covered project. (24 CFR § 135.5)
Subrecipient — An agency or organization that assists the grant recipient in implementing and/or
administering eligible activities.
The greatest extent feasible — Every effort must be made to comply with the regulatory requirements of
Section 3 within their disposal. For instance, this may mean going a step beyond the normal notification
procedures for employment and contracting procedures by developing strategies that will specifically target
Section 3 residents and businesses for these types of economic opportunities.
Very Low - income Person — Families (including single persons) whose household income do not exceed
50 percent of the median family income for the area. (24 CFR §135.5) HUD's income limits may be

Section 3 Compliance
The City of Baytown (and its contractors, subcontractors or subrecipients) will make every effort to comply
with the requirements of Section 3 for new employment, training, or contracting opportunities resulting
from the expenditure of covered funding. The City will:
• Appoint the Community Development Senior Program Manager as the City's Section 3
Coordinator;
• Appoint the Community Development Advisory Committee as the Section 3 Compliance Advisory
Board;
• Implement procedures to notify Section 3 residents and businesses about training, employment, and
contracting opportunities generated by Section 3 covered assistance;
• Notify potential contractors working on Section 3 covered projects of their responsibilities;
• Incorporate Section 3 Clause into all covered solicitations and contracts (Exhibit A);
• Facilitate the training, certification and employment of Section 3 residents and the award of
contracts to Section 3 Business Concerns;
• Maintain a reference list of certified Section 3 residents and businesses;
• Assist and actively cooperate with HUD in making contractors, subcontractors and subrecipients
comply with Section 3 requirements;
• Refrain from entering into contracts with contractors, subcontractors and subrecipients that are in
violation of the Section 3 regulations;
• Document actions taken to comply with Section 3; and
• Submit Section 3 Annual Summary Reports to HUD in accordance with 24 CFR Part 135.90.
Section 3 Certification
During the Community Development pre -bid conferences and at various events throughout the year, the
City of Baytown will provide outreach to recruit residents and businesses for certification and placement
on the Section 3 master list.
Certifying individuals: When a resident seeks Section 3 certification, the responsible City staff will:
❖ Document the inquiry received from the resident asking to be certified under Section 3;
❖ Require the individual to complete a Section 3 Certification Form (Exhibit B);
❖ Verify the applicant's income and residency;
❖ Enter all certified residents into a database for consideration for employment by applicable
contractors and subcontractors; and
•'• Conduct re- certification every three years.
HUD has clarified that a self - certification is an acceptable means for establishing eligibility as a Section 3
Resident. However, the City may require acceptable support documentation with the Section 3 Resident
Certification Form which could include:
• Proof of residency in a public housing development;
• Evidence of participation in a HUD Youthbuild program operated in the metropolitan (or non-
metropolitan county) where the Section 3 covered assistance is spent;
• Copy of Section 8 voucher (or other federally funded housing assistance);
• Evidence of eligibility or participation in a federally- assisted program for low- and very - low -
income persons (e.g. Food Stamps, Jobs, JTPA, Job Corps, etc.);
• Evidence that the individual is receiving unemployment benefits;

- Evidence of homeless as defined under the McKinney Act (42 U.S.C. 11301 et seq.);
- Evidence that the individual resides in the Section 3 area and is a low or very-low- income person,
as defined in Section 3(b) (2) of the U.S. Housing Act of 1937 and;
*Other acceptable documentation approved by the Section 3 Coordinator.
Certifying businesses: Businesses can become Section 3 certified if they meet at least one of the
following HUD requirements:
4 51% owned by a certified Section 3- eligible resident;
4 30% or more of the business' permanent full -time employees are certified Section 3 residents, or within
three years of the date of first employment with the firm were Section 3 residents; or
4 25% or more of all monies spent on the project is sub - awarded to Section 3 subcontractors/businesses.
When a business seeks Section 3 certification, the responsible City staff will:
❖ Document the inquiry received from the business asking to be certified under Section 3;
❖ Require the appropriate company representative to complete a Section 3 Business Concern
Certification Form (Exhibit C);
❖ Verify the applicant's eligibility based on HUD requirements as listed above;
❖ Enter all certified businesses into a database for consideration for all applicable contracts and sub-
contracts; and
❖ Conduct re- certification every three years.
City staff will use discretion when determining the type of verification that is required by prospective
Section 3 business concerns. Some examples include payroll data or other relevant business or IRS
documentation. Section 3 businesses and residents will have the option to become part of a reference list
for the City to use when contracting, subcontracting and/or training opportunities arise. Inclusion on the
Section 3 reference list does not imply endorsement or procurement of the businesses on the list.
Additionally, inclusion on the reference list does not imply that the resident qualifies for the job and/or is
eligible for employment based on criminal background or any other criteria set by the employer. The
reference list is only to serve as a reference that the business and/or resident may qualify as a Section 3
Business Concern or Resident.
Section 3 Preference
HUD requires that preference be given to Section 3 residents in training and employment opportunities and
preference for contracting opportunities be given to Section 3 Business Concerns. As such, the City will
direct its efforts to award Section 3 covered contracts, to the greatest extent feasible, to Section 3 Business
Concerns. In order to attract Section 3 Business Concerns, the City will include the Section 3 Clause
(Exhibit A), in all federally funded bid packets. The City will also require contractors and subcontractors to
post all new hire opportunities with the local Workforce Solutions Center and the Baytown Housing
Authority.
Bids will be solicited from all businesses (Section 3 Business Concerns and non - Section 3 Business
Concerns). However, preference will be given to Section 3 Business Concerns (as certified by the City of

Baytown) who provides goods or services at the best value for the City. In determining the best value, the
City will consider:
(1) the purchase price;
(2) the reputation of the Bidder and of the Bidder's goods or services;
(3) the quality of the Bidder's goods or services;
(4) the extent to which the goods or services meet the City's needs;
(5) the Bidder's past relationship with the City; and
(6) the total long -term cost to the City to acquire the Bidder's goods and services.
A Section 3 Business Concern seeking a contract or a subcontract shall submit evidence to the recipient,
contractor, or subcontractor (as applicable), sufficient to demonstrate to the satisfaction of the party
awarding the contract that the Business Concern is responsible and has the ability to perform successfully
under the terms and conditions of the proposed contract.
Nothing in this policy shall be construed to require the employment or contracting of Section 3 residents or
contractors who do not meet the qualifications of the position or who cannot perform the scope of duties
described in the contract.
Reporting Requirements
The City will document actions taken to comply with the employment, training and contracting
requirements of Section 3, the results of actions taken, and impediments encountered. The City will
maintain records of job vacancies, solicitation of bids or proposals, selection materials and contracting
documents, in accordance with all procurement laws and regulations for applicable Section 3 project. The
documentation should demonstrate efforts taken towards the achievement of the Section 3 numerical goals.
In order to assist the City with reporting requirements, contractors and their subcontractors must submit to
the City a Section 3 Monthly Activity Report (Exhibit D) when completing a Section 3 covered project.
The City will prepare and submit an annual summary report as may be required by HUD.
Complaint Process
Complaints regarding non - compliance with Section 3, must be submitted in writing to the Section 3
Coordinator. All complaints must include the complainant's name, address, telephone number, and a brief
narrative detailing the nature of the complaint. The narrative should include the date of the alleged
violation, circumstances surrounding how the violation was identified and any other relative information.
Complaints should be filed within 30 days after the complainant becomes aware of the alleged violation.
The Section 3 Coordinator will investigate every complaint. All parties involved will have the opportunity
to submit testimony and/or evidence related to the complaint. The Section 3 Coordinator will issue a
written determination within 30 days after the filing of the complaint. Written complaints will be accepted

Section 3 Clause:
Economic Opportunities for Low- and Very Low - Income Persons
All section 3 covered contracts shall include the following clause (referred to as the section 3 clause):
A. The work to be performed under this contract is subject to the requirements of section 3 of the Housing and Urban
Development Act of 1968, as amended, 12 U.S.C. 170lu (section 3). The purpose of section 3 is to ensure that
employment and other economic opportunities generated by HUD assistance or HUD- assisted projects covered by
section 3, shall, to the greatest extent feasible, be directed to low - and very low- income persons, particularly persons
who are recipients of HUD assistance for housing.
B. The parties to this contract agree to comply with HUD's regulations in 24 CFR part 135, which implement section
3. As evidenced by their execution of this contract, the parties to this contract certify that they are under no
contractual or other impediment that would prevent them from complying with the part 135 regulations.
C. The contractor agrees to send to each labor organization or representative of workers with which the contractor
has a collective bargaining agreement or other understanding, if any, a notice advising the labor organization or
workers' representative of the contractor's commitments under this section 3 clause, and will post copies of the notice
in conspicuous places at the work site where both employees and applicants for training and employment positions
can see the notice. The notice shall describe the section 3 preference, shall set forth minimum number and job titles
subject to hire, availability of apprenticeship and training positions, the qualifications for each; and the name and
location of the person(s) taking applications for each of the positions; and the anticipated date the work shall begin.
D. The contractor agrees to include this section 3 clause in every subcontract subject to compliance with regulations
in 24 CFR part 135, and agrees to take appropriate action, as provided in an applicable provision of the subcontract
or in this section 3 clause, upon a finding that the subcontractor is in violation of the regulations in 24 CFR part 135.
The contractor will not subcontract with any subcontractor where the contractor has notice or knowledge that the
subcontractor has been found in violation of the regulations in 24 CFR part 135.
E. The contractor will certify that any vacant employment positions, including training positions, that are filled (1)
after the contractor is selected but before the contract is executed, and (2) with persons other than those to whom the
regulations of 24 CFR part 135 require employment opportunities to be directed, were not filled to circumvent the
contractor's obligations under 24 CFR part 135.
F. Noncompliance with HUD's regulations in 24 CFR part 135 may result in sanctions, termination of this contract
for default, and debarment or suspension from future HUD assisted contracts.
G. With respect to work performed in connection with section 3 covered Indian housing assistance, section 7(b) of
the Indian Self - Determination and Education Assistance Act (25 U.S.C. 450e) also applies to the work to be
performed under this contract. Section 7(b) requires that to the greatest extent feasible (i) preference and
opportunities for training and employment shall be given to Indians, and (ii) preference in the award of contracts and
subcontracts shall be given to Indian organizations and Indian -owned Economic Enterprises. Parties to this contract
that are subject to the provisions of section 3 and section 7(b) agree to comply with section 3 to the maximum extent
feasible, but not in derogation of compliance with section 7(b).

Instructions for completing the Section 3 Monthly Activity Report
The US Department of Housing & Urban Development (HUD) requires the City of Baytown to collect information on
every person hired in connection with Section 3 projects to ensure the City's compliance with federal regulations.
As part of the City of Baytown's Section 3 Program, your firm is required to report the number of employees hired in
connection with a Section 3 project who are Section 3 eligible. This form must be submitted monthly by all firms
working on a Section 3 project.
Enter the names and addresses of all new hires and indicate whether they are a Section 3 resident. (Use additional
sheets if needed.) If yes, have the employee complete a Section 3 Resident Certification Form and submit with the
monthly report.
A Section 3 resident is:
A public housing resident or Section 8 resident or an individual who lives within the Baytown
area and whose income falls within the attached income limits for low or very low income.
