CC Resolution No. 2168 - GLO-CDBGDisasterRecoveryProgramRound2.2RESOLUTION NO.2168 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, AUTHORIZING THE CITY MANAGER TO MAKE APPLICATION TO THE TEXAS GENERAL LAND OFFICE FOR THE COMMUNITY DEVELOPMENT BLOCK GRANT DISASTER RECOVERY PROGRAM, ROUND 2.2, FOR NON -HOUSING ACTIVITIES IN THE AMOUNT OF SIXTEEN MILLION ONE HUNDRED TWO THOUSAND EIGHT HUNDRED NINETY-EIGHT AND NO/100 DOLLARS ($16,102,898.00); DESIGNATING AN AUTHORIZED REPRESENTATIVE; AUTHORIZING THE REPRESENTATIVE TO ACCEPT OR AFFIRM ANY GRANT AWARD THAT MAY RESULT THEREFROM; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. WHEREAS, the City Council of the City of Baytown desires to develop a viable urban community, including decent housing and a suitable living environment and expanding economic opportunities, principally for low/moderate income persons and areas; and WHEREAS, sewer improvements in the low/moderate income areas is a local priority and if not completed would pose a threat to the public health; and WHEREAS, it is necessary for the City of Baytown to apply for funding under the Community Development Block Grant 2008 Supplemental Disaster Recovery Fund Program because such a project cannot be effectively carried out without the disaster recovery funding; and WHEREAS, a public hearing was held on November 21, 2011, to solicit input from the community regarding public infrastructure needs, especially to benefit low/moderate income persons and areas; and WHEREAS, the City desires to submit an application to the Texas General Land Office for the Community Development Block Grant Disaster Recovery Program, Round 2.2 on or before December 9, 2011, for the Central Wastewater Treatment Plant, located at 1709 W. Main Street; and WHEREAS, the Central Wastewater Treatment Plant is the original treatment plant for the City built in 1958; and WHEREAS, this treatment plant is located in the CDBG target area and serves a majority of the low to moderate income population of the City; and WHEREAS, the Central Wastewater Treatment Plant was severely damaged by high winds, heavy rain, storm surge, and was without power during Hurricane Ike; and WHEREAS, funds awarded in Round 2.1 are being used to relocate the existing effluent lift station to a higher site; and WHEREAS, this proposed application for Round 2.2 will continue the project by hardening and elevating the remaining plant and service area lift stations to prevent future flood damage; and WHEREAS, improvements to the Central Wastewater Treatment Plant serving a majority of low/moderate income residents will broaden the City's efforts in affirmatively furthering fair housing initiatives and services to areas occupied by low/moderate income persons and minority concentrations; NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Manager of the City of Baytown is hereby authorized to make application to the Texas General Land Office for the Community Development Block Grant Disaster Recovery Program, Round 2.2, for non -housing activities in the amount of SIXTEEN MILLION ONE HUNDRED TWO THOUSAND EIGHT I IUDRED NINETY-EIGHT AND N01100 DOLLARS ($16,102,898.00). Section 2: That the City Manager is hereby designated as the authorized representative for all purposes under the grant. Section 3: That the City Manager of the City of Baytown is hereby authorized to accept or affirm any grant award that may result from the above application. Section 4: This resolution shall take effect immediately from and after its passage by the City Council of the City of Baytown.
