A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS, ESTABLISHING THE CITY OF BAYTOWN'S LEGISLATIVE
AGENDA FOR THE 2011 STATE AND FEDERAL LEGISLATIVE
SESSIONS; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: That the City Council of the City of Baytown, Texas, hereby establishes
the City of Baytown's Legislative Agenda for the 2011 State Legislative Session, which is
attached hereto as Exhibit"A" and incorporated herein for all intents and purposes.
Section 2: That the City Council of the City of Baytown, Texas, hereby establishes
the City of Baytown's Legislative Agenda for the 2011 Federal Legislative Session, which is
attached hereto as Exhibit"B" and incorporated herein for all intents and purposes.
Section 2: This resolution shall take effect immediately from and after its passage by
the City Council of the City of Baytown.

PRIORITY LEGISLATIVE ISSUES
Budget Issues
✓ Oppose legislation that will require additional services or taxes by cities due to State
budget shortfalls,still placing a burden on local constituents.
Collective Bargaining
✓ Support legislation that would exempt as many cities as possible from any Federal
collective bargaining legislation that may become law in the future.
Public Records Exemptions
✓ To protect Texas residents and state and local first responders,support legislation that
would:
• Exempt from public records all evacuation and special needs registries generated
by, used or kept by City, County or Texas state government entities.
• Exempt from public records all City,County or Texas state emergency operations
plans,operational guides or other documents that may disclose the planning,
preparations, responses or recoveries to disaster threats or events.
Street Maintenance Sales Tax
✓ Support legislation that would authorize the collection of municipal sales and use taxes
for street maintenance for a longer or indefinite term instead of the four years provided
by current law.
Uniform Election Dates
✓ Oppose legislation that would change either of the two uniform election dates.

✓ Oppose legislation that would mandate a reduction in the current ten-percent cap on
annual appraisal growth.

Unfunded Mandates
✓ oppose legislation that requires municipalities to fund former State and Federal
programs without providing a means to recapture the associated costs.
Graffiti Abatement
✓ Support legislation to overturn H.B.2086,which requires cities to offer to abate graffiti
with city funds prior to requiring graffiti abatement.
TxDOT ROW Mowin¢
✓ Support legislation that would give TxDOT the ability to contract directly with cities for
ROW mowing and litter clean up instead of using TxDOT selected contractors.
Erosion of Municipal Authoriri
✓ Oppose legislation that erodes municipal authority in the areas of:
• Municipal Annexation
• Municipal Zoning
• Extraterritorial jurisdictions (ETJ)
Rights-of-way
✓ Oppose legislation that would decrease a city's authority to be adequately compensated
for the use of Its rights-of-way.
✓ Oppose legislation that would erode municipal authority over the management and
control of rights-of-way.
City Sovereign Immunity
✓ Oppose legislation that would erode a city's sovereign immunity.
Condemnation
✓ Oppose legislation that would further erode a city's ability to condemn property for a
public purpose.
Legislative Communication
✓ Oppose legislation that would limit or prohibit the authority of city officials to use
municipal funds to communicate with legislators.

Surface Transportation Reauthorization
1) Pass an extension to the Federal Highway Bill that would preserve funding for localities
in improving local transportation infrastructure
2) Preserve funding for the Safe Routes to School Program under the highway bill to allow
Baytown to compete for dollars to improve walking safety for students around schools
in Baytown city limits
Grant Programs
1) Full funding is requested for the following Federal grant programs to support core
services provided by the City of Baytown:
A. COPS Grant Program
B. Byrne/Justice Assistance Grant Program
C. Community Development Block Grant(CDBG) Program
D. Energy Efficiency and Conservation Block Grant(EECBG) Program
■ Support annual authorized level of$2 billion
National Flood Insurance Plan (NFIP)
1) Support a long-term extension of the National Flood Insurance Plan (NFIP), including a
phase-in of full premiums for residents affected by the recent re-mapping of flood zones
by FEMA
Pesticides
1) Advocate for a legislative amendment in the 112th Congress to the Federal Insecticide,
Fungicide and Rodenticide Act (FIFRA)to clarify that pesticides or any biological control
organism permitted under FIFRA will not be considered a pollutant and therefore avoid
facing unnecessary restrictions by the EPA through the Clean Water Act, as currently
being suggested by the EPA
