CC Resolution No. 2070 - PassPlayPiratesBayGuidelines RESOLUTION NO.2070 A RESOLUTION OF THE CITY COUNCIL OF]'HE CITY OF BAYTOWN,TEXAS, ADOPTING GUIDELINES CONCERNING THE PASS THEN PLAY AT PIRATES BAY PROGRAM:PROVIDING A REPEALING CLAUSE:CONTAINING A SAVINGS CLAUSE:AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,TEXAS: Section 1:That the City Council of the City of Baytown,Texas.hereby adopts the guidelines for the Pass Then Play at Pirates Bay Program,which are attached hereto as Exhibit-A"and incorporated herein for all Intents and purposes. Section 2:All resolutions or parts of resolutions inconsistent with the terms of this resolution are hereby repealed:provided.however.that such repeal shall be only to the extent Of Such inconsistency and in all other respects this resolution shall be cumulative of other resolutions regulating and governing the subject matter covered by this resolution. Section 3:If any provision.section,exception,subsection,paragraph,sentence.clause or phrase of this resolution or the application of same to any person or the set of circumstances.shall for any reason be held unconstitutional,void or invalid.such invalidity shall not affect the validity of the remaining provisions of this resolution or their application to other persons or sets of circumstances and to this end all provisions of this resolution are declared to be severable. Section 4:This resolution shall take effect immediately from and after its passage by the City Council of the City of Baytown. Two(2)eligible youth will have a chance to receive a Pirates Bay season pass.The Program will also provide a mandatory water safety course.This is a limited.pilot program to be conducted during the 2009-2010 Community Development Block Grant(CDBG)Fiscal Year. The Program may be redesigned for future consideration for CD13G funding. The Pass Then Play at Pirates Bay Program provides the following types of assistance: 1.Four(4)one-day passes to Pirates Bay; If.One(1)season pass for the highest scored essay received from applicants between the ages of 13-1 5; Ill.One(I)season pass for the highest scored essay received from applicants between the ages of 16-18:and IV.One(1)mandatory water safety training course at Pirates Bay. The Program requirements are based on the applicant's household income,age,promotion to the next grade level,satisfactory conduct.and residency within the city limits.The applicant shall complete the application process and return the application packet to the Planning and Development Services Department.Community Development Division. Participants may submit with his/her application an optional 500 to 600-ward essay explaining the importance of water safety for a chance to receive a complimentary season pass to Pirates Bay.The essays will be evaluated in two aae categories as noted hereinabove.The applicant receiving the highest score in each age category will be granted a season pass,in addition to the four(4)one-day passes.The essays are optional and not required to participate in the Program. The one-day passes will be granted on a first-come,first-serve basis to eligible youth as funds permit.If the applicant chooses to submit an essay.it must be included with the application submittal. Incomplete applications and/or applications missing support documentation will not be considered.After the first thirty(30)applicants are deemed eligible.all other complete applications will be placed on a wait list in the order received as further discussed hereinbelow. ELIGIBILITY REOUIRENiENTS FOR THE.APPLICATION The application for participation in the Pass Then Play at Pirates Bay Program must be completed by the eligible youth and signed by a parent/guardian.The completed application packet must include copies of applicable documentation to verify the following: Pass Then Play at Pirates[lay Pro&ram,Page I PI3-1 I.Applicant Identification. All applicants must provide photograph identification in the form of the following: A.Copy of state-issued identification card or drivers'license;or B.Current School identification card. if.Household Composition. Household composition should include all persons who occupy the applicant's housing unit at the time of application.The occupants may consist of a single person;group of persons related by birth,marriage,adoption,or law;or a group Of unrelated persons who share living arrangements.Documentation shall include the following information: A.Completed application listing all members of applicant's household with their relation to the applicant.birth date,sex,and declaration of United States citizenship:and B.If a household member is not a United States citizen,he/she must provide proof of legal residency in the form of: 1.United States Passport, 2.Resident Alien Card, 3.Voter's Registration Card, 4.Social Security Card, 5.Sworn Declaration, 6.INS Primary Verification,or 7.Other applicable INS documentation such as Form 1-551,Form 1-94.Form I-688. 111.Household Annual Gross Income. The applicant household's annual gross income must not exceed the maximum income limits calculated each year based on HUD's guidelines and fifty percent (50%)of the median income for residents of the Houston Primary Metropolitan Statistical Area.Documentation for this eligibility requirement shall include,but will not be limited to,all of the following that apply for ALL household members: A.Income tax return(s)for the 2009 tax year for all employed household members: B.Award Letter(s)for Social Security or Veteran's Administration stating amount of monthly benefits: C.Proof of child support,alimony,or separate maintenance; D.Verification of self-employment wages; E.Verification of unemployment wages; F.Food stamp award letter: G.Welfare verification: H.Verification of regular gifts/contributions;and/or 1.Proof of any other source(s)of income. IV.Applicant Age. The applicant must be at least 13 years of age but no older than 18 years of age at the time of application submission.Please submit the following: Pass Then Plav at Pirates Bay Program.Page 2 PB-I A.A copy of birth certificate;or B.Copy of state-issued identification card or drivers'license. V.Applicant Residency. The applicant must provide proof that his/her primary residency is within the city limits of Baytown.Texas.The evidence must be: A.Copy of current utility bill(water,gas.electric)or current lease agreement for parent/guardian:and B.Final Report Card for the 2009-2010 school year with corresponding address for applicant or an equivalent document,such as an official school transcript or other written document from an educational entity dated within the last 90 days. V1.Applicant Grade Level Promotion. Applicant must provide proof that he/she has been promoted to the next grade level.The evidence must be: A.Final Report Card for the 2009-2010 school year.which notes that the applicant has successfully completed the school year and is being promoted to the next grade level or an equivalent document.such as an official school transcript or other written document from an educational entity dated within the last 90 days. Vll.Applicant Satisfactory Conduct. Applicant must provide proof of satisfactory conduct during the entire school year.The evidence must be: A.Final Report Card for the 2009-2010 school year,which lists conduct ratings for all reporting periods or an equivalent document,such as an official school transcript or other written document from an educational entity dated within the last 90 days:and B.The conduct grades must be listed as S(Satisfactory).G(Good),or E (Excellent),or equivalent ratings for the entire 2009-2010 school year. VIll.Optional Essay. If the applicant chooses to submit an essay,it must be included with the application submission.The essay must be: A.Appropriately titled to describe the content of the essay; B.At least 500 words but not more than 600 words; C.Typed in 12-point font with I inch margins;and D.Written about the importance of water safety for youth and must address the following questions: 1.Why is water safety important for teenagers? 2.What can be done to encourage water safety at Pirates Bay? 3.What type of programs and precautions would you develop to prevent water-related accidents at Pirates Bay? Your essay and/or ideas depicted in the essay may be used by the Parks and Recreation Department in the future.By submitting the essay,you are granting the City permission to use the contents without any expectation of acknowledgement and/or compensation. Pass Then Play at Pirates Bay Program,Page 3 PB-I APPLICATION AND ELIGIBILTY PROCESS Once an application has been received by the Planning and Development Services Department,it will be stamped with the date and time of receipt and issued an application number.Staff will review the application and determine eligibility by taking the following steps: 1.Conduct a completeness review of the application to ensure the application is complete and all supporting documentation is attached.The completeness review will also note the age of the applicant and whether an essay has been submitted. If the application is not complete and/or all supporting documentation is not included.the applicant will be notified in writing of his/her ineligibility.The applicant may re-submit the application as long as applications are still being accepted; 2.Evaluate the completed application for compliance with the application eligibility requirements as listed in the above sections for household composition,household income,residency,and age.If information on the application is not in compliance with the program eligibility requirements,the applicant will be notified in writing of his/her ineligibility: 3.Evaluate the supporting documentation to determine if the contents are consistent with the completed application.Supporting documentation must comply with the program eligibility requirements as listed in the above sections for household composition,household income,residency,age,grade promotion,and satisfactory conduct.If the supporting documentation is not consistent with the completed application and/or is not in compliance with the program eligibility requirements, the applicant will be notified in writing of his/her ineligibility: 4.Note the application with an eligibility status and assign an eligible applicant number.based on date/time received. MANDATORY WATER SAFETY TRAINING COURSE Every eligible applicant must complete a City-sponsored water safety training course held at Pirates Bay.The City of Baytown Parks and Recreation Department will conduct at least two(2) sessions of the water safety training course.Eligible applicants will be assigned a date and a time to attend one of the water safety training sessions.If an otherwise eligible applicant fails to attend the assigned water safety training session,he/she will be deemed ineligible and disqualified from receiving the one-day passes. Upon completion of the required water safety training course,the eligible applicant will be issued four(4)one-day passes to Pirates Bay.The one-day passes may be used by the applicant and/or his/her chosen guest(s). The one-day passes may be used at any time during normal operating hours in the 2010 season. All rules associated with the one-day passes.which are posted at Pirates Bay,are applicable and will be enforced.Failure to adhere to the rules and regulations established for Pirates Bay may result in revocation of the day pass and expulsion from the park. Pass Then Play at Pirates Bay Proeram,Page 4 PB-l There are only thirty(30)spaces available to receive four(4)one-day passes through this Program,which will be issued on a first-come,first-serve basis to eligible applicants.During the eligibility review,all applications will be assigned a number,based on the date and time received.At any point during the eligibility process,if an applicant is deemed ineligible,the next numbered application will be used to fill its space.Once all thirty(30)spaces are identified. the remaining eligible applications will be placed on a wait list until all eligible applicants have completed the mandatory water safety training course to which they have been assigned.If an eligible applicant fails to complete the mandatory water safety training course,eligible applicants from the wait list will be contacted in order accordina to the waitlist until all one-day passes are issued.Every applicant will receive written notice of his/her application status. ESSAY REVIEW PROCESS Applicants may submit an essay on the importance of water safety for youth to receive a complimentary season pass to Pirates Bay for the 2010 season.This essay is optional and will have no bearing on eligibility to participate in the Program.If the applicant chooses to submit an essay,it must be included in his/her original application submittal.The City will not accept an essay after the application has been received and stamped for submission.Once all thirty(30) eligible applicants have been determined and completed the mandatory water safety training course,the submitted essays for those thirty(30)eligible applicants will be reviewed.Only the thirty(30)eligible applicants can be considered for the complimentary season pass in the essay competition.The essays will be reviewed by taking the following steps: 1.Conduct a completeness review to determine if the essay: A.Includes an appropriate title for the topic; B.Is at least 500 words but not more than 600 words;and C.Is typed in 12-point font with 1 inch margins. If the essay does not meet these criteria,the applicant will be notified via letter of his/her ineligibility to receive the complementary season pass; 2.Assign the complete essays in two age categories of the eligible applicants,a) ages 13-15 and b)ages 16-18: 3.Evaluate the essays based on the following: A.Topic-subject matter matches the required topic; B.Organization-the writing flows logically with clear structure; C.Style of writing-the use of age-appropriate wording and sentence structure: D.Quality of writing-use of correct grammar,punctuation and spelling: E.Creativity-illustrates originality in thought:and F.Evidence-use of references or sources to support ideas. 4.Assign a weighted score of I-10(lowest to highest)to each criterion.The scores will be totaled to determine a final score for the essay.All essays will be evaluated by a committee of four(4)staff members designated by the City Manager and one(1)member of the Community Development Advisory Committee: Pass Then Play at Pirates Bay Program,Page 5 PB-t 5.In the event of a tie of essay scores,select the winning applicant based on applicant number.which is assigned by the date and time he/she submitted his/her completed application;and 6.Notify and issue one(1)applicant in each age category,who receives the highest score of his/her successfully being chosen to receive a Pirates Bay season pass. There is no opportunity to appeal the decision of the committee as its decision on scoring the essays and issuing the season passes is final. The season passes may be used at any time during normal operating hours in the 2010 season by the eligible applicant only.All rules associated with the season passes,which are posted at Pirates Bay,are applicable and will be enforced.Failure to adhere to the rules and regulations established for Pirates Bay may result in revocation of the season pass and expulsion from the park.
