CC Resolution No. 2046 - Disannexation Rhodia RESOLUTION NO.2046 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,TEXAS, GRANTING THE PETITION OF RHODIA.INC.,CONCERNING THE DISANNEXATION OF A PORTION OF THEIR PROPERTY THAT IS IN THE CITY LIMITS AND SURROUNDED BY INDUSTRIAL DISTRICT NO.1,HARRIS COUNTY,TEXAS;AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. WHEREAS,Section 43.142 of the Texas Local Government Code provides that the City may disannex property within its corporate limits:and WHEREAS,the City of Baytown has received a petition filed by Rhodia.Inc.,concerning the disannexation of a portion of their property that is in the city limits and surrounded by Industrial District No.1,Harris County.Texas;and WHEREAS,on this date,the City Council heard the petition and the arguments for and against the disannexation and desires to grant the petition:NOW THEREFORE BE IT RESOLVED BY T14E CITY COUNCIL OF THE CITY OF BAYTOWN,TEXAS: Section 1:That the City Council of the City of Baytown,Texas_hereby grants the petition of Rhodia,Inc..concerning the disannexation of a portion of their property that is in the city limits and surrounded by Industrial District No.I.Harris County,Texas.Said petition is attached hereto as Exhibit"A,"and incorporated herein for all intents and purposes. Section 2:This resolution shall take effect immediately from and fter its passage by the City Council of the City of Baytown. Rhodia acknowledges that Rhodia has not paid ad valorem taxes to the City of Baytown on the property subject to this disannexation petition and/or the City of Baytown has already refunded all taxes and fees collected concerning the property subject to this disannexation petition pursuant to its past Industrial District Agreements with the City of Baytown.As such,Rhodia hereby covenants and agrees that it is not entitled to any refund pursuant to Section 43.148 of the Texas Local Government Code and will make no claim for the same for tax years through 2010.Rhodia intends for this assertion and waiver to be binding upon Ithodia and to be relied upon by the City of Baytown in considering the grant of this petition.
