A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,TEXAS.
ADOPTING AN ADDENDUM TO THE CITY OF BAYTOWN'S WATER
CONSERVATION PLAN ADOPTED VIA RESOLUTION NO.1979 ON APRIL 7,
2009:AND PROVIDING FOR THE EFFECTIVE DATE THEREOF.

BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN.TEXAS:
Section l:That the City Council of the City of Baytown.Texas,hereby adopts an addendum to
its Water Conservation Plan adopted via Resolution No.1979 on April 7,2009,consistent with Section
13.146 of the Texas Water Code.Said addendum is attached hereto as Exhibit"A"and is incorporated
herein for all intents and purposes.
Section 2:This resolution shall take effect immediately from and after its passage by the City
Council of the City of Baytown.

ADDENDUM
To The
CITY OF BAYTOWN,TEXAS
Water Conservation/Emergency Water Demand Management Plan
In addition to the existing language of the Water Conservation Plan adopted April 7,
2009,the Emergency Management Plan(Drought Contingency Plan)is further amended
to include the following:
Section VIII:RESPONSE STAGES
STAGE I-ALERT:
Voluntary Water Use Restrictions:
Target:Achieve a voluntary 5%percent reduction in total water use.
STAGE 11-MILD WATER USE RESTRICTIONS:
Voluntary Water Use Restrictions:
Target:Achieve a voluntary 5%percent reduction in total water use.
STAGE III-MODERATE WATER USE RESTRICTIONS:
Voluntary Water Use Restrictions:
Target:Achieve a voluntary 10%percent reduction in total water use.
STAGE IV-CRITICAL WATER USE RESTRICTIONS:
Demand or Capacity-Based Triggers(in addition)
•Natural or man-made contamination of the water supply source(s).
Voluntary Water Use Restrictions:
Target:Achieve a voluntary 10%percent reduction in total water use.
Section IX:Pro Rata Water Allocation
In the event that the triggering criteria specified in Section VII of the Plan for Stage IV t Critical
Water Shortage Conditions have been met,the City Manager is hereby authorized initiate
allocation of water supplies on a pro rata basis in accordance with Texas Water Code Section
11.039.
WHOLESALE CONTRACT RENEWAL:
All Water supply contracts entered into by the City(such as a MUD District)will require
a Water Conservation/Emergency Demand Management Plan within one year of the
signing of the contract.In every contract entered into or renewed after adoption of the
plan,including contract extensions.will include that in case of a shortage of water
resulting from drought,the water to be distributed shall be divided in accordance with
Texas Water Code,§11.039.
