A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS, ADOPTING LOCAL MITIGATION STRATEGIES FOR INCLUSION
IN THE HARRIS COUNTY ALL-HAZARD MITIGATION PLAN; AND
PROVIDING FOR THE EFFECTIVE DATE THEREOF.
WHEREAS, certain areas of the City of Baytown are subject to periodic flooding,
hurricanes and other natural hazards with the potential to cause personal injury and/or property
damage within the area; and
WHEREAS, the City of Baytown desires to prepare and mitigate for such circumstances;
and
WHEREAS, under the Disaster Mitigation Act of 2000, the United States Federal
Emergency Management Agency (FEMA) requires that local jurisdictions have in place a
FEMA-approved Hazard Mitigation Action Plan as a condition of receipt of certain future
federal mitigation funding after May 1, 2005; and
WHEREAS, Harris County and certain municipalities, in order to meet this requirement,
developed a county-wide, multi jurisdictional All Hazard Mitigation Plan, including the City of
Baytown; and
WHEREAS, the City Council adopted the Harris County All Hazard Mitigation Plan via
Resolution No. 1806, adopted on July 13, 2006 (the "Plan"); and
WHEREAS, the Plan is required to be reviewed and updated every five (5) years; and
WHEREAS, the City has reviewed the plan and desires to adopt the local mitigation
strategies incorporated herein, which are not intended to be all-inclusive but are intended for use
in the City's planning and projections, for inclusion in the Plan; NOW THEREFORE
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: That all matters and facts set forth in the recitals hereinabove are found to
be true and such recitals are hereby approved and made a part of this Resolution for all purposes
and are adopted as a part of the judgment and findings by the City Council of the City of
Baytown, Texas.
Section 2: That the City Council of the City of Baytown, Texas, hereby adopts the
local mitigation strategies, which are attached hereto as Exhibit "A" and incorporated herein for
all intents and purposes, for inclusion in the City of Baytown's addendum to the Harris County
All Hazard Mitigation Plan.
Section 3: That the City Council of the City of Baytown, Texas, hereby vests
Stephen H. DonCarlos, Mayor; Garrison C. Brumback, City Manager; and the Office of
Emergency Management with the responsibility, authority and the means to:
(a) Inform all concerned parties of this action; and
(b) Develop an addendum to this Hazard Mitigation Plan if the City of Baytown's
unique situation warrants such an addendum.
Section 4: That the City Council of the City of Baytown, Texas, hereby appoints
Stephen H. DonCarlos, Mayor; Garrison C. Brumback, City Manager; and the Office of
Emergency Management to assure that the Hazard Mitigation Plan be reviewed at least annually
and that any needed adjustment to the City of Baytown's addendum to the Hazard Mitigation
Plan be developed and presented to the City Council for consideration.
Section 5: That the City Council of the City of Baytown, Texas, hereby agrees to
take such other official action as may be reasonably necessary to carry out the objectives of the
Hazard Mitigation Plan.
Section 6: This resolution shall take effect immediately from and after its passage by
the City Council of the City of Baytown.
