CC Resolution No. 1932 - Centerpoint Meter System Filings TCUC RESOLUTION NO. 1932 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, AUTHORIZING THE CITY TO PARTICIPATE IN PUC DOCKET NOS. 35620 AND 35639, DEALING WITH THE DEPLOYMENT OF ADVANCED METERS IN THE SERVICE TERRITORY OF CENTERPOINT ENERGY HOUSTON ELECTRIC THROUGH A COALITION OF CITIES KNOWN AS TEXAS COAST UTILITIES COALITION; AUTHORIZING THE HIRING OF COUNSEL AND EXPERTS THROUGH THE TEXAS COAST UTILITIES COALITION; REQUIRING THE REIMBURSEMENT OF REASONABLE RATE CASE EXPENSES; MAKING SUCH OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. WHEREAS, CenterPoint Energy Houston Electric, LLC filed two applications at the Public Utility Commission of Texas ("PUC") dealing with deployment of advanced meters in PUC Docket Nos. 35620 and 35639; and WHEREAS, as part of Docket No. 35639, CenterPoint is requesting recovery of over $400 million in costs related to the deployment of advanced meters; and WHEREAS, CenterPoint is requesting that two surcharges be implemented on an interim basis in July, 2008; and WHEREAS, CenterPoint is requesting that all residential customers be surcharged $1.75/month and that customers of Retail Electric Providers ("REPs") with advanced meters would be subject to their REP being billed a $4.75/month surcharge by CenterPoint; and WHEREAS, the Deployment Plan as presented in CenterPoint's applications contends that there are no offsetting benefits or savings to CenterPoint; and WHEREAS, CenterPoint's proposal for its Deployment Plan will result in ratepayers subjected to the imposition of surcharges on their electric bills at a time when electric prices are at record highs; and WHEREAS, the procedural schedule proposed for the two dockets is extremely aggressive, especially in light of the fact that CenterPoint filed its application in the two proceedings in May 2008; and WHEREAS, the two proceedings require the specialized knowledge of experts who understand the ratemaking and practical effects of CenterPoint's deployment of advanced meters as set forth in the two applications. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: The statements and findings set out in the preamble to this resolution are hereby in all things approved and adopted. Section 2: The City is authorized to participate with Texas Coast Utilities Coalition in PUC Docket Nos. 35620 and 35639 and take such actions as are recommended by the Steering Committee of TCUC, including the selection of counsel or experts to work on behalf of TCUC. Section 3: CenterPoint shall reimburse within 30 days after submission, the reasonable rate case expenses with regard to PUC Docket No. 35639 and PUC Docket No. 35620, to the extent that it is or becomes part of a ratemaking proceeding. Section 4: This resolution shall take effect immediately from and after its passage by the City Council of the City of Baytown.
