A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS, GRANTING T14E PETITION OF GARTH ROAD HOLDINGS, LLC.,
CONCERNING THE ANNEXATION OF A TRACT OF LAND OUT OF
BLOCK ONE HUNDRED-FORTY (140), UNIT "D," ELENA FRUIT AND
COTTON FARMS, A SUBDIVISION OUT OF THE WASHINGTON
COUNTY RAILROAD SURVEY IN HARRIS COUNTY, TEXAS,
ACCORDING TO THE MAP OR PLAT THEREOF OF RECORD IN VOLUME
7, PAGE 48 - 49 OF THE MAP RECORDS OF HARRIS COUNTY, TEXAS;
AUTHORIZING THE PREPARATION OF A SERVICE PLAN; AND
PROVIDING FOR THE EFFECTIVE DATE THEREOF.
WHEREAS, Section 43.052 of the Texas Local Government Code provides that tine City
may annex property without an annexation plan if the area contains fewer than 100 separate
tracts of land on which one or more residential dwellings are located on each tract or if more than
50 percent of the real property owners in the area proposed for annexation submit a petition for
annexation; and
WHEREAS, the City of Baytown has received a petition tiled by Garth Road Holdings,
LLC., concerning the annexation of a tract of land out of Block One Hundred Forty (140), Unit
"D." Elena Fruit and Cotton Farms, a subdivision out of the Washington County Railroad survey
in Harris County, Texas, according to the map or plat thereof of record in Volume 7, Page 48 -
49 of the Map Records of Harris County, Texas; and
WHEREAS, on this date, the City Council heard the petition and the arguments for and
against the annexatio❑ and desires to grant the petition; NOW THEREFORE
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: That the City Council of the City of Baytown, Texas, hereby grants the
petition of Garth Road Holdings, LLC., concerning the annexation of a tract of land out of Block
One Hundred Forty (140), Unit "D," Elena Fruit and Cotton Farms, a subdivision out of the
Washington County Railroad survey in Harris County, Texas, according to the map or plat
thereof of record in Volume 7, Page 48 - 49 of the Map Records of Harris County, Texas. Said
petition is attached hereto as Exhibit "A," and incorporated herein for all intents and purposes.
Section 2: That the City Council of the City of Baytown, Texas, hereby authorizes
and directs the Planning and Development Services Department to prepare a service plan for the
property identified in Section 1 hereof.
Section 3: This resolution shall take effect immediately from and after its passage by
the City Council of the City of Baytown.

BEING a tract of land out of Block One Hundred-forth 1140), Unit "D", ELENA FRUIT AND
COTTON FARMS,a subdivision out of the Washington County Railroad survey in Harris County,
Texas, according to the map or plat thereof of record in Volume 7, Page 48-49 of the Map
Records of Harris County,Texas, said tract being described by motes and bounds as follows,
to-wit:
BEGINNING at the intersection of the West line of Garth Road with the North line of the Ceder
Bayou-Lynchburg Road;
THENCE North 09 deg.53 min.West,along the West line of Garth Road,a distance of 537.40
feet to a stake for POINT OF BEGINNING of tract herein described,same being South 09 deg.
53 min. East,a distance of 440 feet from the Northeast comer of that certain 9.546 acre tract
