RESOLUTION NO. 1892
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS,
GRANTING RECOGNITION OF THE BAYTOWN MUNICIPAL POLICE
ASSOCIATION (BMPA) AS THE SOLE AND EXCLUSIVE BARGAINING AGENT
FOR THE POLICE OFFICERS EMPLOYED BY THE CITY OF BAYTOWN, TEXAS,
EXCLUDING THE CHIEF AND EXEMPT EMPLOYEES; DETERMINING THAT
THE CITY MAY MEET AND CONFER WITH THE BMPA UNDER SUBCHAPTER
B OF CHAPTER 142 OF THE TEXAS LOCAL GOVERNMENT CODE WITHOUT
CONDUCTING AN ELECTION; AND PROVIDING FOR THE EFFECTIVE DATE
THEREOF.
WHEREAS, Subchapter B of Chapter 142 of the Texas Local Government Code provides a
mechanism whereby the police through an association may petition the City Council for the City to meet
and confer on terms and conditions of employment; and
WHEREAS, such petition must request recognition of the association as the sole and exclusive
bargaining agent for all police officers employed by the City, excluding the Chief and employees exempt
under Section 142.058 ("excluded employees"); and
WHEREAS, such petition must be signed by a majority of all police officers, not including the
excluded employees: and
WHEREAS, the City Council received such a petition on October 11, 2007, requesting that the
Baytown Municipal Police Association be recognized as the sole and exclusive bargaining agent; and
WHEREAS, within 30 days after receiving the petition, the City Council must take one of the
following actions:
I. grant recognition of the association and determine by majority vote that the City may meet and
confer without conducting an election;
2. defer granting the recognition of the association and order an election by the voters regarding
whether the City may meet and confer; or
3. order a certification election to determine whether the association represents a majority of the
affected police officers; and
WHEREAS, the City Council of the City of Baytown believes that it is most appropriate to grant
the recognition of the Baytown Municipal Police Association and to determine that the City may meet and
confer without conducting an election; NOW THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS:
Section 1: That the City Council of the City of Baytown hereby grants recognition of the
Baytown Municipal Police Association as the sole and exclusive bargaining agent for the police officers
employed by the City of Baytown, Texas, excluding the Chief and employees exempt under Section
142.058 of the Texas Local Government Code; and
Section 2: That the City Council of the City of Baytown hereby determines that the City
may meet and confer with the Baytown Municipal Police Association under Subchapter B of Chapter 142
of the Texas Local Government Code without conducting an election.

Section 3: This resolution shall take effect immediately from and after its passage by the
City Council of the City of Baytown.
