CC Resolution No. 1877 65 RESOLUTION NO. 1877 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, ESTABLISHING THE CITIZENS BOND ADVISORY COMMITTEE; APPROVING THE CHARTER OF SUCH COMMITTEE FOR THE PROJECTS INCLUDED IN THE NOVEMBER 2007 BOND ELECTION; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section L That the City Council of the City of Baytown, Texas, hereby creates and establishes the Citizens Bond Advisory Committee to oversee projects included in the November 2007 Bond Election for which bonds are approved by the voters in such election. Section 2: That the City Council of the City of Baytown, Texas, hereby approves the Charter of the Citizens Bond Advisory Committee for the projects included in the November 2007 Bond Election for which bonds are approved by the voters in such election. A copy of such charter is attached hereto as Exhibit "A" and incorporated herein for all intents and purposes. Section 3: This resolution shall take effect immediately from and after its passage by the City Council of the City of Baytown, Texas. PURPOSE The purpose of the Citizens Bond Advisory Committee for the 2007 Bond Program is to maintain routine involvement with elected officials and City personnel by: • Examining compliance to scope, cost, schedule, and quality of materials and work; • Reviewing and endorsing to the City Council any significant changes proposed to the various projects within the 2007 Bond Program; and • Studying and recommending communications updates to the community. II. COMMITTEE MEMBERS Committee members are selected by the 2007 Bond Steering Committee, subject to Council confirmation, based on participation in the planning of the current Bond Program as well as ensuring community-wide representation. Committee target size is approximately twelve members. Membership includes: - Co-Chair(s) of the 2007 Bond Planning Committee; [TBN, TBN]; - Four Representatives of the 2007 Bond Planning Committees (Streets, Public Buildings and Finance) [TBN, TBN, TBN, TBN]; - Member Appointed by the Baytown Chamber of Commerce [TBN]; - Member appointed by the Hispanic Chamber of Commerce [TBN]; - Member appointed by the Baytown/West Chambers Economic Development Foundation [TBN]; and - At least one representative from each City Council Districts (if not already represented in another appointment) [number as necessary: TBN, TBN, TBN, TBN] III. RATIONALE FOR COMMITTEE PROCESS In 1999, the Baytown Economic Development Foundation and the Baytown Chamber of Commerce formed a study group to identify recommendations for Goose Creek CISD to effectively manage the 1999 bond projects. A Citizens Bond Construction Advisory Committee (CBCAC) was formed in September 1999 and operated throughout the bond program. The subsequent 2005 Goose Creek CISD Bond Program followed the same format from the 1999 bond program. On February 28, 2005, the Goose Creek CISD Board of Trustees passed a resolution establishing a Citizens Bond Advisory Committee to monitor the scope and execution of the 2005 bond program. This process has proven to be a successful partnership between the voting public and GCCISD. This format should be useful, particularly in a bond program of the size and scope proposed for 2007. This enhanced communications and accountability back to the bond planning process will benefit the City of Baytown staff as well as the City Council Members by ensuring that implementation follows the plan proposed in adoption. V. EXPECTATIONS • Committee members possess a sincere interest in the continued improvements to city infrastructure; public safety; growth & development; quality of life of residents of the City of Baytown and the overall success of the 2007 Bond Program. • Committee members will make every attempt to attend regularly scheduled meetings (i.e., weekly, bi-weekly, or monthly luncheon meetings and monthly or bi-monthly evening meetings). • Committee members will be able to communicate well with community members. • Committee members will provide some special ability that will help bring this program to a successful completion. • Committee members will participate actively. 3 VI. COMMITTEE RESPONSIBILITIES To provide the City of Baytown staff with cost effective guidance in the execution of the 2007 Bond Program, the responsibilities include: • Serve as a first-line advisory team to the City staff construction team. • Assist in the City's Architectural and Engineering Committee with selection of the architects and engineers. • Endorse architectural and engineering designs. • Review and endorse construction schedules and progress. • Oversee the management of the construction, the technology, and the street selection portions of the Bond budget. • Endorse city staff recommendations, where and when appropriate, for bond-related construction projects. VII. COMMITTEE OPERATION • Recommendations will be reached through the use of consensus. Voting scenarios may be used when consensus cannot be achieved. • Subcommittees may be formed to best complete tasks. • Individual or subcommittee tasks will be reported to the whole committee. Vill. COMMITTEE TASKS • Utilize expertise in project management to assist the City in a successful bond program. • Provide input on the Statements of Qualifications (SOQ's) for design and engineering professionals. • Review summary documents returned for SOQ's. • Participate, where and when appropriate, in interviewing candidates for design and engineering firms. • Participate in the recommendation for architectural resources. • Review and endorse drawings for facilities as required by the architects and the City. • Review schedules and cost information on a monthly basis in the early stages of the program and make recommendations for potential improvements. • Review and approve minutes from committee meetings. • Provide input to the City on the technology portions of the Bond Program. • Share information with the community. • Present subcommittee recommendation(s) (if subcommittees are formed) to full committee. • Working with the City staff, endorse recommendation(s) pending legal review to the City Council. 4
