PREPARATION OF A SERVICE PLAN; AND PROVIDING FOR THE
EFFECTIVE DATE THEREOF.
WHEREAS, Section 43.052 of the Texas Local Government Code provides that the City
may annex property without an annexation plan if the area contains fewer than 100 separate
tracts of land on which one or more residential dwellings are located on each tract; and
WHEREAS, the City of Baytown has received a petition filed by 219-I.H. 10, Ltd., a
Texas limited partnership, I.H. Ten-70, Ltd., a Texas limited partnership, I.H. Ten-116, Ltd., a
Texas limited partnership, Baytown Riceland Venture, JV, a Texas joint venture, and Ten Main-
Baytown, Ltd., a Texas limited partnership, concerning the annexation of a 571.841 acre tract of
land being a 1 16.133-acre tract described as of Tracts 1, 2, 3, 4, and 5 in the Warranty Deed with
Vendor's Lien recorded under Harris County Clerk's File No. F592126 of the real property
records of Harris County, Texas; a 69.95-acre tract described in the General Warranty Deed
recorded under Harris County Clerk's File No. G061967 of the real property records of Harris
County, Texas, a 116.00-acre tract described in the General Warranty Deed recorded under
Harris County Clerk's File No. G061963, a 43.31-acre tract described in the Special Warranty
Deed with Vendor's Lien Recorded under Harris County Clerk's File No. T086062, and a
226.453-acre tract described under Harris County Clerk's File No. G350652; and
WHEREAS, on this date, the City Council heard the petition and the arguments for and
against the annexation and desires to grant the petition; NOW THEREFORE

BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: That the City Council of the City of Baytown, Texas, hereby grants the
petition of 219-I.H. 10, Ltd., a Texas limited partnership, I.H. Ten-70, Ltd., a Texas limited
partnership, I.H. Ten-116, Ltd., a Texas limited partnership, Baytown Riceland Venture, JV, a
Texas joint venture, and Ten Main-Baytown, Ltd., a Texas limited partnership, concerning the
annexation of a 571.841 acre tract of land being a 116.133-acre tract described as of Tracts 1, 2,
3, 4, and 5 in the Warranty Deed with Vendor's Lien recorded under Harris County Clerk's File
No. F592126 of the real property records of Harris County, Texas; a 69.95-acre tract described in
the General Warranty Deed recorded under Harris County Clerk's File No. G061967 of the real
property records of Harris County, Texas, a l 16.00-acre tract described in the General Warranty
Deed recorded under Harris County Clerk's File No. G061963, a 43.31-acre tract described in
the Special Warranty Deed with Vendor's Lien Recorded under Harris County Clerk's File No.
T086062, and a 226.453-acre tract described under Harris County Clerk's File No. G350652.
Said petition is attached hereto as Exhibit "A," and incorporated herein for all intents and
purposes.
Section 2: That the City Council of the City of Baytown, Texas, hereby authorizes
and directs the City staff to prepare a service plan for the property identified in Section 1 hereof.
Section 3: This resolution shall take effect immediately from and after its passage by
the City Council of the City of Baytown.

PETITION FOR ANNEXATION
THE STATE OF TEXAS §
COUNTY OF HARRIS §
TO THE HONORABLE MAYOR AND CITY COUNCIL OF THE CITY OF BAYTOWN:
The undersigned owners of the Land described below hereby petition the City of
Baytown to annex the Land into the corporate limits of the City. A legal description of the Land
is attached as Exhibit "A." Such Land contains 571.841 total acres and is comprised of the five
following tracts located adjacent to the north boundary of Interstate 10 and west of Sjolander
Road:
(1) 219- I.H. 10, Ltd. owns a 226.453 acre tract described in deed dated December 3,
1979, recorded under Harris County Clerk's File No. G350652;
(2) I.H. Ten-70, Ltd. owns a 69.952 acre tract described in deed dated March 7, 1979,
recorded under Harris County Clerk's File No. G061967;
(3) I.H. Ten-116, Ltd. owns a 116 acre tract described in deed dated March 7, 1979,
recorded under Harris County Clerk's File No. G061963;
(4) Baytown Riceland Venture, JV owns a 43.3084 acre tract described in deed dated
June 15, 1998, recorded under Hams County Clerk's File No. T086062; and
(5) Ten Main-Baytown, Ltd. owns a 116.14059 combined acres as described in deed
dated July 14, 1997, recorded under Harris County Clerk's File No. F592126.
