CC Resolution No. 1831 4 RESOLUTION NO. 1831 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, SUPPORTING (I) THE EXTENSION OF AUTHORITY AND JURISDICTION OF THE CHAMBERS COUNTY-CEDAR BAYOU NAVIGATION DISTRICT; (II) DISANNEXATION OF CERTAIN PROPERTY FROM THE CHAMBERS COUNTY-LIBERTY COUNTY NAVIGATION DISTRICT; (III) EXPANSION OF THE EXISTING BOARD OF DIRECTORS OF THE CHAMBERS COUNTY-CEDAR BAYOU NAVIGATION DISTRICT FROM FIVE TO SEVEN, AND (IV) SUPPORTING LEGISLATION BE INTRODUCED TO ACCOMPLISH SUCH GOAL; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. WHEREAS, Cedar Bayou has evolved into a vital asset to Chambers County and the City of Baytown by providing recreational and business opportunities and growth to its citizens; and WHEREAS, its development as a valuable asset should be carefully managed so that local interests affected thereby will be protected; and WHEREAS, two political subdivisions of the State have the authority to conceive and control projects to improve the Bayou's navigability; and WHEREAS, it is desirable to consolidate that authority over the Bayou in a single entity; NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown, Texas, supports the extension of authority and jurisdiction of the Chambers County-Cedar Bayou Navigation District over the entirety of Cedar Bayou — from Mile Marker 11 at the Highway 146 bridge, thence downstream to its mouth and, following the existing channel across upper Galveston Bay to its intersection with the Houston Ship Channel, as more particularly depicted in Exhibit "A," which is attached hereto and incorporated herein for all intents and purposes. Section 2: That the City Council of the City of Baytown, Texas, supports the disannexation from the Chambers County-Liberty County Navigation District of that portion of west Chambers County now in the Chambers County-Liberty County Navigation District—those lands lying approximately west of the Old & Lost Rivers, and east of Cedar Bayou. Section 3: That the City Council of the City of Baytown, Texas, supports that the boundaries resultant of the supported extension and disannexation will exclude residential and municipal property from assessment by the Chambers County Cedar Bayou Navigation District. Section 4: That the City Council of the City of Baytown, Texas, supports the expansion of the existing Board of Directors of the Chambers-County-Cedar Bayou Navigation 5 District from five to seven, to include two new positions of voting directors, residents of the City of Baytown, one selected by the City Council of the City of Baytown and one by the Mayor of the City of Baytown and desires: l. that qualifications for board membership be amended to reflect this change; and 2. that the Chairman of the Board of the Navigation District be appointed from the Board of Directors by the Chamber County Judge upon consultation with the Mayor of the City of Baytown. Section 5: That the City Council of the City of Baytown, Texas, supports legislation to accomplish the objectives specified herein be filed with the Texas Legislature and diligently prosecuted until passage and signing by the Governor Section 6: This resolution shall take effect immediately from and after its passage by the City Council of the City of Baytown.
