CC Resolution No. 1825 96 RESOLUTION NO. 1825 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS; AUTHORIZING AND DIRECTING THE CHIEF OF POLICE TO ADOPT A POLICY REGARDING TOWING VEHICLES BEING DRIVEN WITHOUT PROOF OF FINANCIAL RESPONSIBILITY; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. WHEREAS, the City Council of the City of Baytown has determined that motorists who do not maintain financial responsibility are a hazard to the citizens of the City of Baytown, causing increases in insurance premiums for those individuals who do maintain automobile liability insurance; and WHEREAS, the City Council of the City of Baytown has determined that the Baytown Police Department would be more effective if it adopted a policy allowing its officers to order the towing of vehicles operated by persons who do not have proof of financial responsibility in accordance with the laws of the State of Texas; NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section l: That the matters and matters set forth in the recitals of this resolution are hereby found to be true and correct. Section 2: That the chief of police is hereby authorized and directed to adopt a policy to be effective from and after January 1, 2007, for towing motor vehicles when persons, operating motor vehicles within the city, either fail to maintain or cannot present proof of financial responsibility required by the state. Under the policy, police officers shall be authorized to cause a motor vehicle to be removed and/or impounded when: 1. the officer determines that the operator cannot present proof of the required financial responsibility and has been previously convicted of or received deferred adjudication for operating a vehicle without the requisite financial responsibility; or 2. in the case of an accident, the officer determines that an involved vehicle was operated without the required financial responsibility.
