CC Resolution No. 1806 68 RESOLUTION NO. 1806 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, ADOPTING THE HARRIS COUNTY ALL HAZARD MITIGATION PLAN; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. WHEREAS, certain areas of the City of Baytown are subject to periodic flooding, hurricanes and other natural hazards with the potential to cause personal injury and/or property damage within the area; and WHEREAS, the City of Baytown desires to prepare and mitigate for such circumstances; and WHEREAS, under the Disaster Mitigation Act of 2000, the United States Federal Emergency Management Agency (FEMA) requires that local jurisdictions have in place a FEMA-approved Hazard Mitigation Action Plan as a condition of receipt of certain future federal mitigation funding after May 1, 2005; and WHEREAS, Harris County and certain municipalities, in order to meet this requirement, have initiated development of a countywide, multi-jurisdictional All Hazard Mitigation Plan, including the City of Baytown; NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown, Texas, hereby adopts the Harris County All Hazard Mitigation Plan. Section 2: That the City Council of the City of Baytown, Texas, hereby vests Stephen H. DonCarlos, Mayor; Gary Jackson, City Manager; and the Office of Emergency Management with the responsibility, authority and the means to: (a) Inform all concerned parties of this action; and (b) Develop an addendum to this Hazard Mitigation Plan if the City of Baytown's unique situation warrants such an addendum. Section 3: That the City Council of the City of Baytown, Texas, hereby appoints Stephen H. DonCarlos, Mayor; Gary Jackson, City Manager; and the Office of Emergency Management to assure that the Hazard Mitigation Plan be reviewed at least annually and that any needed adjustment to the City of Baytown's addendum to the Hazard Mitigation Plan be developed and presented to the City Council for consideration. Section 4: That the City Council of the City of Baytown, Texas, hereby agrees to take such other official action as may be reasonably necessary to carry out the objectives of the Hazard Mitigation Plan. 69 Section 5: This resolution shall take effect immediately from and after its passage by the City Council of the City of Baytown.
