CC Resolution No. 1804 64 RESOLUTION NO. 1804 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, OPPOSING THE IMPLEMENTATION OF CHARGES FOR SERVICES RENDERED BY THE HARRIS COUNTY MEDICAL EXAMINER'S OFFICE; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. WHEREAS, the Harris County Medical Examiner notified the City of Baytown by written correspondence that the Medical Examiner's Office would begin billing for requested laboratory services; and WHEREAS, services rendered by the Medical Examiner's Office have historically been furnished at no additional cost, similar to other County taxpayer supported services such as the District Attorney's Office, the County and District Court system and the County Jail system, etc.; and WHEREAS, incorporated cities in Harris County and other police agencies were never consulted prior to the announcement of the imposition of charges; and WHEREAS, the proposed fee schedule amounts to a double-billing for services, in that the residents of Baytown participate mightily in the ad valorem taxation of Harris County residents; and WHEREAS, the proposed fee schedule will result in an unfunded annual mandate costing the taxpayers of Baytown approximately ONE HUNDRED THOUSAND AND NO/100 DOLLARS ($100,000.00); NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown, Texas: a. stands firmly opposed to the proposed fee schedule and any fee that amounts to a double-taxation of the residents of the City of Baytown; b. respectfully requests of Harris County that prior to the consideration and imposition of any fees proposed for services of the Harris County Medical Examiner's Office that the City of Baytown be contacted and consulted; and c. believes that the implementation of any fees proposed for services of the Harris County Medical Examiner's Office may adversely affect prosecution in Baytown and throughout Harris County. Section 2: This resolution shall take effect immediately from and after its passage by the City Council of the City of Baytown. 65 INTRODUCED, READ and PASSED by the affirmative vote of the City Council of the City of Baytown this the 13th day of July, 2006.
