A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS, GRANTING THE PETITION OF GARTH-ARCHER, CHARLES H.
GRUBE, LTD., CONCERNING THE ANNEXATION OF A 1.5878 ACRE
TRACT OF LAND SITUATED IN THE W.C. RAILROAD COMPANY
SURVEY, ABSTRACT 899 AND THE W.G. BOSWELL SURVEY,
ABSTRACT 1562, HARRIS COUNTY, TEXAS, AND BEING OUT OF AND A
PART OF THAT CERTAIN CALLED 126.735 ACRE TRACT ONE
CONVEYED BY FLORENCE GODFREY, ET AL, TO GARTH-ARCHER,
CHARLES H. GRUBE, LTD., BY DEED DATED FEBRUARY 15, 1973, AND
RECORDED UNDER COUNTY CLERK'S FILE NO. D806833 OF THE DEED
RECORDS OF HARRIS COUNTY, TEXAS; AND PROVIDING FOR THE
EFFECTIVE DATE THEREOF.
WHEREAS, Section 43.028 of the Texas Local Government Code provides for the
annexation of certain sparsely populated property upon the written petition of the owners of the
property and all persons or entities with an interest therein; and
WHEREAS, the City of Baytown has received such a petition filed by Garth-Archer,
Charles H. Grube, Ltd., for the annexation of a 1.5878 acre tract of land situated in the W.C.
Railroad Company Survey, Abstract 899 and the W.G. Boswell Survey, Abstract 1562, Hams
County, Texas, and being out of and a part of that certain called 126.735 acre Tract One
conveyed to Florence Godfrey, et al, to Garth-Archer, Charles H. Grube, Ltd., by deed dated
February 15, 1973, and recorded under County Clerk's File No. D806833 of the Deed Records of
Harris County, Texas; and
WHEREAS, on this date, the City Council heard the petition and the arguments for and
against the annexation and desires to grant the petition; NOW THEREFORE
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: That the City Council of the City of Baytown, Texas, hereby grants the
petition of Garth-Archer, Charles H. Grube, Ltd., concerning the annexation of a 1.5878 acre
tract of land situated in the W.C. Railroad Company Survey, Abstract 899 and the W.G. Boswell
Survey, Abstract 1562, Harris County, Texas, and being out of and a part of that certain called
126.735 acre Tract One conveyed to Florence Godfrey, et al, to Garth-Archer, Charles H. Grube,
Ltd., by deed dated February 15, 1973, and recorded under County Clerk's File No. D806833 of
the Deed Records of Harris County, Texas. Said petition is attached hereto as Exhibit "A," and
incorporated herein for all intents and purposes.
Section 2: This resolution shall take effect immediately from and after its passage by
the City Council of the City of Baytown.

described by the following metes and bounds, to-wit:

CENTRAL ZONE,NAD 83. ALL DISTANCES ARE ACTUAL DISTANCES.
SCALE FACTOR=0.9998832. REFERENCE IS MADE TO THE PLAT OF EVEN
DATE ACCOMPANYING THIS METES AND BOUNDS DESCRIPTION.
COMMENCING at a point in the East right-of-way line of Garth Road (right-of-way
width varies) and in the West line of said called 126.735 acres. Said point being the
Northwest comer of that certain 0.3367 of an acre Parcel "A" as described in Amendment
to Pipeline Agreement between Texas Brine Co., LLC and Garth-Archer, Charles H.
Grube, LTD, dated October 18, 2002 and recorded under County Clerk's File No.
W 161718 of the Official Public Records of Real Property of Harris County, Texas.
THENCE: North 69°40'52" East along the North line of said 0.3367 of an acre for a
distance of 250.39 feet to a point in the existing City Limits of the City of Baytown,
Texas for the Southwest corner and POINT OF BEGINNING of this tract.
THENCE: North 08°24'24" West along the West line of this tract and the existing City
Limits of the City of Baytown, Texas, parallel with and 300 feet perpendicular from the
centerline of Garth Road, for a distance of 393.96 feet to a point for the Northwest
corner of this tract.
THENCE: North 81035'36"East along the North line of this tract for a distance of
198.47 feet to a point for the Northeast corner of this tract.
THENCE: South 08a24'24"East along the East line of this tract for a distance of 270.33
feet to a ''/2 inch iron rod, with cap, set for an angle point in the North line of that certain
4.5856 acre tract of land conveyed by Garth-Archer, Charles H. Grube, LTD to Diamond
Shamrock Corp. by Deed dated April 1, 1977 and recorded under County Clerk's File

line of this tract.

said 0.3367 of an acre for a distance of 81.12 feet to the PLACE OF BEGINNING and
